HomeMy WebLinkAbout17135 1 RESOLUTION NO. 17,135 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH ALLR, LLC FOR THE PURCHASE OF 5 CERTAIN REAL PROPERTY LOCATED AT 17 BUTTERMILK ROAD, 6 ALSO KNOWN AS LOT 176, STURBRIDGE SUBDIVISION, PHASE III, 7 TO THE CITY OF LITTLE ROCK,ARKANSAS, FOR THE PURPOSE OF 8 DEVELOPING AFFORDABLE HOUSING;TO AUTHORIZE THE USE OF 9 COMMUNITY DEVELOPMENT BLOCK GRANT-DISASTER 10 RECOVERY FUNDS FOR THE PURCHASE; AND FOR OTHER 11 PURPOSES. 12 13 WHEREAS, the City of Little Rock, Arkansas (the "City"), acting through its Housing and 14 Neighborhood Programs Department, is committed to increasing the availability of affordable housing 15 within the City of Little Rock; and, 16 WHEREAS, the City desires to acquire certain vacant residential property located at 17 17 Buttermilk Road, legally described as Lot 176 Sturbridge Subdivision, Phase III to the City of Little 18 Rock, Pulaski County,Arkansas (the "Property"), containing approximately 2,236/10,454 square feet 19 lot; and, 20 WHEREAS,the Property is located within an established residential neighborhood consisting 21 primarily of single-family homes and is suitable for residential development; and, 22 WHEREAS,the City desires to purchase the Property from ALLR,LLC for the purchase price 23 of Two Hundred Twenty-Five Thousand and 00/100 Dollars ($225,000.00), subject to the terms and 24 conditions of a contract approved as to form by the City Attorney; and, 25 WHEREAS, following acquisition of the Property,the Housing and Neighborhood Programs 26 Department intends to facilitate the construction of a new single-family residential unit on the Property, 27 which shall be offered for sale to eligible person(s) in accordance with applicable City, federal, and 28 program requirements; and, 29 WHEREAS,the City of Little Rock has been awarded Twenty Million Eight Hundred Ninety- 30 Five Thousand and 00/100 Dollars ($20,895,000.00) in CDBG-DR funds by the United States 31 Department of Housing and Urban Development ("HUD") to support long-term recovery efforts [Page 1 of 3] 1 following the severe storms and tornadoes that occurred on March 31, 2023, which were declared a 2 major disaster under FEMA Disaster Declaration DR-4698; and, 3 WHEREAS, CDBG-DR funds are intended to address unmet disaster-related needs by 4 assisting impacted residents and neighborhoods through activities including housing recovery, 5 infrastructure and public facility improvements, economic revitalization, public services, and 6 mitigation activities;and 7 WHEREAS,the acquisition and subsequent development of the Property for affordable single- 8 family housing is consistent with the City's objectives for the use of CDBG-DR funds and is subject to 9 all applicable federal, State, and local laws, regulations, program requirements, and applicable HUD 10 requirements; and 11 WHEREAS, the City Manager is authorized to execute contracts and other documents on 12 behalf of the City when authorized by the Board of Directors. 13 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 14 CITY OF LITTLE ROCK,ARKANSAS: 15 Section 1.The Board of Directors hereby authorizes the City Manager to enter into a contract 16 with ALLR LLC, for the purchase of the vacant residential property located at 17 Buttermilk Road, 17 legally described as Lot 176 Sturbridge Subdivision, Phase II1, to the City of Little Rock, Pulaski 18 County,Arkansas, containing approximately 2,236/10,454 square foot lot, for a purchase price not to 19 exceed Two Hundred Twenty-Five Thousand and 00/100 Dollars($225,000.00). 20 Section 2. The purchase of the Property shall be funded through the City's Community 21 Development Block Grant—Disaster Recovery (CDBG-DR) Program, Funding Source 22 2340008/G35DR25HO, subject to the availability of appropriated funds and compliance with all 23 applicable CDBG-DR and HUD requirements. 24 Section 3. The Housing and Neighborhood Programs Department is authorized to use the 25 Property for the development of a new-construction single-family residential unit to be sold to eligible 26 person(s) in accordance with applicable CDBG-DR program requirements, the City's affordable 27 housing policies and procedures,and all applicable federal, State, and local laws and regulations. 28 Section 4. The City Manager is further authorized to execute such additional documents as 29 may be reasonably necessary to complete the acquisition of the Property,including,without limitation, 30 the purchase agreement, closing documents, deeds, affidavits, certifications, and other documents 31 necessary to effectuate the transaction, provided such documents are approved as to form by the City 32 Attorney. The City Manager and appropriate City staff are authorized to take all actions 2 necessary to implement the provisions of this Resolution, including completion of all required 3 environmental review, title, appraisal, inspection, eligibility, and other CDBG-DR compliance 4 requirements applicable to the acquisition and development of the Property. 5 Section 6. The provisions of this Resolution are hereby declared to be severable, and in the 6 event any section, paragraph, subdivision, or provision of this Resolution shall be held invalid or 7 unconstitutional,the same shall not affect the validity of the remaining portions of this Resolution. 8 Section 7.Severability. In the event any title,section,paragraph,item,sentence,clause,phrase, 9 or word of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration 10 or adjudication shall not affect the remaining portions of the ordinance which shall remain in full 11 force and effect as if the portion so declared or adjudged invalid or unconstitutional was not 12 originally a part of the ordinance. 13 Section 8. Repealer.
