HomeMy WebLinkAbout17133 1 RESOLUTION NO. 17,133 2 3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER 4 INTO A CONTRACT WITH ALLR, LLC FOR THE PURCHASE OF 5 CERTAIN REAL PROPERTY LOCATED AT 10702 BRECKENRIDGE 6 DRIVE, ALSO KNOWN AS LOT 99, WALNUT VALLEY, AN ADDITION 7 TO THE CITY OF LITTLE ROCK, ARKANSAS, FOR THE PURPOSE OF 8 DEVELOPING AFFORDABLE HOUSING;TO AUTHORIZE THE USE OF 9 COMMUNITY DEVELOPMENT BLOCK GRANT-DISASTER 10 RECOVERY FUNDS FOR THE PURCHASE; AND FOR OTHER 11 PURPOSES. 12 13 WHEREAS, the City of Little Rock, Arkansas (the "City"), acting through its Housing and 14 Neighborhood Programs Department, is committed to increasing the availability of affordable housing 15 within the City of Little Rock; and, 16 WHEREAS, the City desires to acquire certain vacant residential property located at 10702 17 Breckenridge Drive, legally described as Lot 99 Walnut Valley,an addition to the City of Little Rock, 18 Pulaski County,Arkansas(the"Property"),containing approximately 10,018 square feet lot; and, 19 WHEREAS,the Property is located within an established residential neighborhood consisting 20 primarily of single-family homes and is suitable for residential development; and, 21 WHEREAS,the City desires to purchase the Property from ALLR,LLC for the purchase price 22 of Sixty Thousand and 00/100 Dollars ($60,000.00), subject to the terms and conditions of a contract 23 approved as to form by the City Attorney; and, 24 WHEREAS, following acquisition of the Property,the Housing and Neighborhood Programs 25 Department intends to facilitate the construction of a new single-family residential unit on the Property, 26 which shall be offered for sale to eligible person(s) in accordance with applicable City, federal, and 27 program requirements;and, 28 WHEREAS,the City of Little Rock has been awarded Twenty Million Eight Hundred Ninety- 29 Five Thousand and 00/100 Dollars ($20,895,000.00) in CDBG-DR funds by the United States 30 Department of Housing and Urban Development ("HUD") to support long-term recovery efforts 31 following the severe storms and tornadoes that occurred on March 31, 2023, which were declared a 32 major disaster under FEMA Disaster Declaration DR-4698; and, [Page 1 of 3] 1 WHEREAS, CDBG-DR funds are intended to address unmet disaster-related needs by 2 assisting impacted residents and neighborhoods through activities including housing recovery, 3 infrastructure and public facility improvements, economic revitalization, public services, and 4 mitigation activities; and 5 WHEREAS,the acquisition and subsequent development of the Property for affordable single- 6 family housing is consistent with the City's objectives for the use of CDBG-DR funds and is subject to 7 all applicable federal, State, and local laws, regulations, program requirements, and applicable HUD 8 requirements; and 9 WHEREAS, the City Manager is authorized to execute contracts and other documents on 10 behalf of the City when authorized by the Board of Directors. 11 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 12 CITY OF LITTLE ROCK,ARKANSAS: 13 Section 1.The Board of Directors hereby authorizes the City Manager to enter into a contract 14 with ALLR LLC, for the purchase of the vacant residential property located at 10702 Breckenridge 15 Drive,legally described as Lot 99 Walnut Valley,an addition to the City of Little Rock,Pulaski County, 16 Arkansas, containing approximately 10,018 square feet, for a purchase price not to exceed Sixty 17 Thousand and 00/100 Dollars($60,000.00). 18 Section 2. The purchase of the Property shall be funded through the City's Community 19 Development Block Grant—Disaster Recovery (CDBG-DR) Program, Funding Source 20 2340008/G35DR25HO, subject to the availability of appropriated funds and compliance with all 21 applicable CDBG-DR and HUD requirements. 22 Section 3. The Housing and Neighborhood Programs Department is authorized to use the 23 Property for the development of a new-construction single-family residential unit to be sold to eligible 24 person(s) in accordance with applicable CDBG-DR program requirements, the City's affordable 25 housing policies and procedures, and all applicable federal, State, and local laws and regulations. 26 Section 4. The City Manager is further authorized to execute such additional documents as 27 may be reasonably necessary to complete the acquisition of the Property, including,without limitation, 28 the purchase agreement, closing documents, deeds, affidavits, certifications, and other documents 29 necessary to effectuate the transaction, provided such documents are approved as to form by the City 30 Attorney. 31 Section 5. The City Manager and appropriate City staff are authorized to take all actions 32 necessary to implement the provisions of this Resolution, including completion of all required [Page 2 of 3] 1 environmental review, title, appraisal, inspection, eligibility, and other CDBG-DR compliance 2 requirements applicable to the acquisition and development of the Property. 3 Section 6. The provisions of this Resolution are hereby declared to be severable, and in the 4 event any section, paragraph, subdivision, or provision of this Resolution shall be held invalid or 5 unconstitutional,the same shall not affect the validity of the remaining portions of this Resolution. 6 Section 7.Severability. In the event any title,section,paragraph,item,sentence,clause,phrase, 7 or word of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration 8 or adjudication shall not affect the remaining portions of the ordinance which shall remain in full 9 force and effect as if the portion so declared or adjudged invalid or unconstitutional was not 10 originally a part of the ordinance. 11 Section 8. Repealer.
