3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A
5 SOLE-SOURCE CONTRACT WITH WEAVER-BAILEY
6 CONTRACTORS, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED
7 TWO THOUSAND, ONE HUNDRED EIGHTY-FIVE DOLLARS
8 ($102,185.00),TO COMPLETE AN EMERGENCY DEMOLITION OF THE
9 MARICHAM STREET PEDESTRIAN BRIDGE, TO DECLARE AN
10 EMERGENCY; AND FOR OTHER PURPOSES.

12 WHEREAS,on July 13,2026,a truck owned and operated by Arkansas Mini Dumpsters,LLC struck
13 the Markham Street Pedestrian Bridge,displacing the span,shearing the steel anchor bolts, and displacing
14 the elastomeric bearings; and,
15 WHEREAS,on July 14,2026,the City of Little Rock("City")retained Micheal Baker International,
16 to perform a visual inspection of the structure and based upon that inspection it was determined that given
17 the severity of the impact to the steel beams and concrete deck that the City needed to demolish the
18 pedestrian bridge to protect the public safety,health,and welfare of the City; and,
19 WHEREAS, on July 16, 2026, the Department of Public Works submitted a written request for a
20 proposal to multiple contractors based upon bridge,transportation and heavy construction experience; and
21 WHEREAS,the City received three responses to its request; and
22 WHEREAS, the City has chosen Weaver Bailey Contractors to complete the demolition of the
23 Markham Street Pedestrian Bridge.
24 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
25 OF LITTLE ROCK,ARKANSAS:
26 Section 1. The City Manager is hereby authorized to execute a contract not to exceed the amount of
27 one hundred two thousand one hundred eighty-five dollars ($102,185.00) which includes a twenty (20)
28 percent contingency fee.
29 Section 2. Funding for the project is from the 3/8 Cent Capital Improvement Sales and
30 Compensating Use Tax Funds and 2018 Capital Improvement Bonds as authorized by Resolution
31 14,803. Account Activity 326409 TS40A07.
32 Section 3. Severability. In the event any title, paragraph, item, sentence, clause, phrase, or word of
33 this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication

1 shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the
2 portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution.
3 Section 4.Repealer. All laws,ordinances,resolutions,or parts of the same,which are inconsistent with
4 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
5 Section 5.Emergency Clause. The emergency demolition of the Markham Street Pedestrian Bridge is
6 essential to the public health,safety and welfare;an emergency is declared to exist and this ordinance shall
7 be in full force and effect from and after the date of its passage.
