3 A RESOLUTION TO ACCEPT TITLE TO PROPERTY DONATED TO
4 THE CITY OF LITTLE ROCK BY WARRANTY DEED,TO BE USED FOR
5 NEIGHBORHOOD REVITALIZATION PROGRAMS LOCATED AT 1220
6 WEST 23RD STREET, LITTLE ROCK, ARKANSAS 72206; AND FOR
7 OTHER PURPOSES.

9 WHEREAS,the Board of Directors has stated that one of its primary goals is a desire to provide
10 for neighborhood revitalization, and has taken special efforts to accomplish this goal through its use of
11 various City and federal funds,and in affirmative actions such as the creation of a Land Bank Commission;
12 and,
13 WHEREAS, in order to accomplish this goal, it is required that properties be obtained by the City
14 in areas that are appropriate for revitalization;and,
15 WHEREAS, Ngan Overton has indicated her desire to donate to the City of Little Rock her
16 property located at 1220 W 23rd Street, Little Rock,AR 72206(See Appraisal as Exhibit A hereto);and,
17 WHEREAS, the City wishes to accept the property for use in its neighborhood revitalization
18 efforts; and,
19 WHEREAS,City Staff has conducted a title search of the Property and has determined that valid
20 title exists and that there are no significant title issues affecting the conveyance of the Property to the City;
21 and,
22 WHEREAS,Ngan Overton will provide the City with a Warranty Deed conveying the property to
23 the City; and,
24 WHEREAS,state law requires that the City accept the property by resolution adopted by the Board
25 of Directors.
26 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
27 CITY OF LITTLE ROCK,ARKANSAS:
28 Section 1.The Board of Directors hereby accepts the donation of the real property located at 1220
29 W.23rd Street,Little Rock,Arkansas 72206,from Ngan Overton,subject to conveyance by Warranty Deed
30 and approval of all closing documents by the City Attorney.
31 Section 2. The Property shall be held and used for a public purpose, specifically in furtherance of
32 the City's neighborhood revitalization, redevelopment,land banking,affordable housing, and other related
33 City revitalization programs.

1 Section 3.The City Manager and City Attorney are hereby authorized to execute and approve such
2 documents and take such actions as may be necessary to effectuate the acceptance of the Property and
3 implement the intent of this Resolution.
4 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
5 phrase,or word of this resolution is declared or adjudged to be invalid or unconstitutional,such declaration
6 or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
7 effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
8 ordinance.
9 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
10 with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
