D. ANALYSIS:
The property located at 48 Orle Circle is in a predominantly R-2 zoned neighborhood off of Chenal Valley Drive in west Little Rock.
The residence is new construction and consists of a 4,859 square foot two-story masonry home. The lot itself is 84.95 feet in width and 135.14 in depth. The applicant is requesting an
“after the fact” variance. The present owner is the contractor who built the residence and inadvertently constructed the structure within the side and rear yard setbacks. The survey
submitted shows that the northwest side yard setback at 7.7 feet and the rear (west) setback at 23.6 feet
Section 36-254(d)(2) states There shall be a side yard set-back on each side of the building having a width of not less than ten(10) percent of the average width of the lot, not to exceed
eight (8) feet. Therefore, the applicant is requesting a variance to allow a reduction of .3 feet to 7.7 feet.
Section 36-254(d)(3) states There shall be a rear yard setback having a depth of not less than twenty-five feet. Therefore, the applicant is requesting a variance to allow a reduction
of the rear yard setback of 1.4 feet to 23.6 feet.
Although Staff is not in favor of approving variances after the work had been completed, Staff is supportive of the requested variances. Staff views the request as reasonable. Staff
believes the proposed request will have no adverse impact on the adjacent properties or the general area.
E. Staff Recommendation:
Staff recommends approval of the requested side yard setback reduction from 8 feet to a minimum of 7.7-feet and a reduction of the rear yard setback from 25 feet to no less than 23.6
feet.

The applicant was present. There were no objectors present.
Staff presented the application to the Board and stated it recommended
approval as per the staff report.
The item remained on the consent agenda for approval. There was a consent
motion to approve the application. The motion was seconded. The application
was approved on consent. The vote was 3 ayes, 0 nays and 2 absent. The motion passed.
