3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID;TO AUTHORIZE THE CITY TO ENTER INTO AN AGREEMENT
5 WITH THE BEZOS EARTH FUND AND THE LITTLE ROCK REGIONAL
6 CHAMBER OF COMMERCE TO PROVIDE FUNDS FOR A MORE DEFI-
7 NITE DESIGN OF 30 CROSSING;AND FOR OTHER PURPOSES.

9 WHEREAS, the City has been involved in a project to develop the area under the recently completed
10 extension of the 1-30 in downtown Little Rock;and,
11 WHEREAS, the Bezos Earth Fund, working through the Little Rock Chamber of Commerce ("the
12 Chamber"),has provided potentially thirty million dollars($30,000,.000.00)in funds to further design and
13 expand opportunities within the area and,
14 WHEREAS, the City has the opportunity to contract with the Chamber and combine its monies with
15 those under the control of the Chamber,particularly an amount of up to five million dollars($5,000,000.00)
16 to more specifically provide design work for infrastructure and other matters necessary to provide further
17 development in the area;and,
18 WHEREAS, the ability to take advantage of the funds that are controlled by the Chamber is unique
19 and makes it impossible to subject such an agreement to formal competitive selection processes;
20 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The Board of Directors declares that it is impractical and unfeasible to subject a contract
23 for further design of infrastructure and other matters in the area known as 30 Crossing to competitive se-
24 lection in light of the monies donated to, and under the control of,the Chamber for this project.
25 Section 2. The Mayor, City Manager, and City Clerk are authorized to execute any documents, in a
26 form approved by the City Attorney,necessary to accomplish this initial design work through a combination
27 of funds controlled by the Chamber and provided by the City.
28 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
29 phrase,or word of this ordinance is declared or adjudged to be invalid or unconstitutional,such declara-
30 tion or adjudication shall not affect the remaining portions of the ordinance which shall remain in full
31 force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a
32 part of the ordinance.

1 Section 4.Repealer. All laws, ordinances,resolutions, or parts of the same,that are inconsistent with
2 the provisions of this resolution,are hereby repealed to the extent of such inconsistency including,but not
3 limited to Little Rock,Ark.,Ordinance No.21,700(March 5,2019).
