3 A RESOLUTION TO APPROVE THE ABANDONMENT OF A PORTION
4 OF THE "T" STREET RIGHT-OF-WAY LOCATED IMMEDIATELY
5 WEST OF WATT STREET(G-23-499);AND FOR OTHER PURPOSES.

7 WHEREAS,the owner of the adjacent property has requested the abandonment of approximately
8 103.7 linear feet of the"T"Street right-of-way located immediately west of Watt Street; and,
9 WHEREAS, the requested abandonment is associated with the Access Village - POD (Z-10083-
10 A)development approved by the Board of Directors on May 5, 2026; and,
11 WHEREAS, the portion of"T" Street requested for abandonment is a paved two-lane roadway
12 with curb and gutter and sidewalk on the south side,and has historically been utilized for access to a school
13 campus. See Exhibits A and B; and,
14 WHEREAS, a portion of"T" Street further west within the same block has previously been
15 abandoned;and,
16 WHEREAS,none of the public utility companies object to the proposed abandonment, subject to
17 the following conditions and comments:
18 1. AT&T approves the right-of-way abandonment, provided a utility
19 easement is retained on the south side of"T" Street in the area in question for an existing
20 fiber line attached to Entergy poles;
21 2. Central Arkansas Water has no objection provided easements remain in
22 place for public water utilities;
23 3. Entergy has no objection,provided it may maintain its existing overhead
24 primary line within the proposed abandonment area unless relocated at the developer's
25 expense;
26 4. Little Rock Water Reclamation Authority has no objection with the
27 understanding that the existing 60-foot"T"' Street right-of-way will not be affected;
28 5. Summit Utilities,Arkansas, does not oppose the abandonment, subject
29 to continued coordination regarding any impacts to existing natural gas facilities and
30 reimbursement by the requesting party for any relocation or related costs; and
31 WHEREAS,according to Pulaski County Title records,there are no reversionary rights associated
32 with the right-of-way proposed for abandonment; and, ���,�►mit ,,,,,,,�

1 WHEREAS,the abandoned right-of-way area will be incorporated into the adjacent properties for
2 future development; and,
3 WHEREAS, on April 9, 2026, the Planning Commission voted 8 ayes, 0 noes, with 2 absent and
4 1 open position, as part of the consent agenda associated with Access Village — POD (Z-10083-A), to
5 approve the right-of-way abandonment,with no objectors present; and,
6 WHEREAS, all property owners located within 300 feet of the site and all neighborhood
7 associations registered with the City of Little Rock were notified of the public hearing for the POD
8 development,which included the proposed right-of-way abandonment.
9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
10 CITY OF LITTLE ROCK,ARKANSAS:
11 Section 1.The Board of Directors hereby approves the abandonment of approximately 103.7 linear
12 feet of the "T" Street right-of-way located immediately west of Watt Street, as depicted and described in
13 application G-23-499.
14 Section 2. The abandonment is approved subject to the retention of any necessary utility easements
15 and compliance with the requirements and conditions identified by the affected utility providers.
16 Section 3. The City Manager and City Clerk are hereby authorized to execute any documents
17 necessary to effectuate this abandonment.
18 Section 4.This resolution shall be in full force and effect from and after its adoption.
19 Section 5. Severability. In the event any portion of this Resolution is declared or adjudged to be
20 invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this
21 Resolution, which shall remain in full force and effect as if the portion so declared or adjudged invalid or
22 unconstitutional was not originally a part of this Resolution.
23 Section 6. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict
24 with any provision of this ordinance are hereby repealed to the extent of such conflict.
