3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A
5 CONTRACT WITH ROBERTS-MCNUTT, IN AN AMOUNT NOT TO
6 EXCEED EIGHTY-NINE THOUSAND, SEVEN HUNDRED EIGHTY-
7 TWO DOLLARS ($89,782.00) PLUS APPLICABLE TAXES AND FEES,
8 FOR A NEW ROOF ON THE CITY HALL ANNEX BUILDING; TO
9 DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES.

11 WHEREAS,the City Hall annex building is in urgent need of a new roof;and,
12 WHEREAS, it has been determined that the current roof has leaks which are causing interior
13 damage throughout the building; and,
14 WHEREAS, Roberts-McNutt, A TIPS-authorized contractor (TIPS contract #23010401), has
15 provided a proposal to replace the existing roof,flash curbs and other penetrations,clean up and dispose of
16 debris, and provide a 20-year no dollar limit warranty to include labor and materials;and,
17 WHEREAS,the proposed replacement is essential to preserve the structural integrity of City Hall
18 and to help prevent further interior damage; and,
19 WHEREAS, the total cost of the repairs shall not exceed Eighty-Nine Thousand Seven Hundred
20 Eighty-Two and 00/100 Dollars ($89,782.00); Seventy-Four Thousand Eight Hundred Eighteen Dollars
21 ($74,818.00), with a 20% contingency plus applicable taxes and fees and the use of a TIPS cooperative
22 contract ensures compliance with procurement requirements and cost efficiency;and,
23 WHEREAS. Because of the construction nature of this work, it is more appropriate to enter into
24 this agreement as a sole source agreement in order to more quickly address this emergency issue;
25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK,ARKANSAS:
27 Section 1. The Board of Directors declares that, because of the nature of the unforeseen damage to
28 the roof and the need to provide for the safety of its employees and the structural integrity of the building,
29 it is impractical and unfeasible to bid this agreement.
30 Section 2. The City Manager is authorized to enter into a contract with Roberts-McNutt in the amount
31 of exceed Eighty-Two and 00/100 Dollars($89,782.00); Seventy-Four Thousand Eight Hundred Eighteen
32 00/100 Dollars ($74,818.00), with a 20% contingency plus applicable taxes and fees for the purpose of a
33 new roof on the City Hall Annex building as described.

1 Section 3. Funds are available from the Building Services Facilities Improvement Account#108409
2 -S400636.
3 Section 4. Severability.In the event any portion of this Ordinance is declared or adjudged to be invalid
4 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this
5 Ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or
6 unconstitutional was not originally a part of this ORdinance.
7 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
8 any provision of this ordinance are hereby repealed to the extent of such conflict.
9 Section 6.Emergency Clause. The unforeseeable damage to the roof of this building places City
10 employees and visitors at risk, as well as creates problems with the structural integrity of the building, which
11 must be immediately repaired in order to protect the public safety, health, and welfare;an emergency is
12 declared to exist and this Ordinance shall be in full force and effect from and after the date of its passge;
13 further, any actions taken prior to the formal passage of this Ordinance to correct the damage to the roof is
14 hereby ratified.
