HomeMy WebLinkAbout17089 1 RESOLUTION NO. 17,089 2 3 A RESOLUTION TO EXTEND THE FRIDA PLAZA TEMPORARY 4 ENTERTAINMENT DISTRICT, FOR THE DATES OF JUNE 20, 2026, 5 THROUGH SEPTEMBER 20,2026; AND FOR OTHER PURPOSES. 6 7 WHEREAS, on July 23, 2019, the Board of Directors of the City of Little Rock, Arkansas, 8 passed Little Rock, Ark., Ordinance No. 21,761 as amended which permitted the creation of a 9 Temporary Entertainment District pursuant to Arkansas State Law and City Ordinance;and, 10 WHEREAS,the Temporary Entertainment District will be named Plaza Frida,and will be held 11 at 4001 West 65th Street and aim to honor and celebrate various aspects of Hispanic culture and local 12 businesses through traditional music,dance,culinary experiences and community engagement; and, 13 WHEREAS, the proposed dates and times as directed by Little Rock, Ark. Ordinance No. 14 21,761 are Saturdays and Sundays from June 20, 2026, through September 20, 2026, from 11:00 a.m. 15 to 9:00 p.m.;and, 16 WHEREAS,the Temporary Entertainment District will not substantially interrupt the safe and 17 orderly movement of other pedestrian or vehicular traffic contiguous to its location; and, 18 WHEREAS, the concentration of persons within the Temporary Entertainment District will 19 not unduly interfere with proper Fire and Police protection of, or ambulance service to, areas of 20 contiguous to its location;and, 21 WHEREAS, adequate sanitation and other required health facilities are or will be made 22 available in or adjacent to its location; and, 23 WHEREAS, there is sufficient parking available in or near its location to accommodate the 24 number of vehicles reasonably expected during the time of the District's existence; and, 25 WHEREAS,no Temporary Entertainment District application for any of the same date(s)and 26 location(s)have already been approved or was previously received and will be approved; and, 27 WHEREAS, no Temporary Entertainment District application for the same date, or within a 28 time frame within twenty-four (24) hours of the same date has been previously received and will be 29 granted, which will require the use and deployment of public resources in such a manner that when 30 combined with the subsequent application, it is reasonably determined that there would be an adverse 31 effect upon the City's ability to provide such resources and to protect the welfare and safety of persons 32 and property, provided that the mere expenditure of public funds for overtime payments for public 33 employees shall not be deemed an adverse effect upon the City's ability to provide public services;and [Page 1 of 4] 1 WHEREAS,no event is scheduled elsewhere in the City where the public resources required 2 for that event are so great that the deployment of public services associated with the Temporary 3 Entertainment District would be adversely affected in a way detrimental to the welfare and safety of 4 persons and property; and, 5 WHEREAS,nothing in this resolution prevents the Chief of Police of the Little Rock Police 6 Department, or the Chief of the Little Rock Fire Department, to suspend the operation hours of any 7 Entertainment District if necessary to comply with local, State or Federal Laws or Fire Codes, or is 8 necessary to protect public health, safety and welfare;and, 9 WHEREAS, the City Board of Directors has determined the creation of a Temporary 10 Entertainment District as proposed by Little Rock, Ark. Ordinance No. 21,761 as amended, is 11 appropriate as recommended by the Planning & Development Department. 12 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 13 OF LITTLE ROCK,ARKANSAS. 14 Section 1. The Plaza Frida Temporary Entertainment District is hereby established by the 15 City of Little Rock as a Temporary Entertainment District on Tuesday,June 16,2026, and subject to 16 Little Rock, Ark. Ordinance No. 21,761 as amended and its defined terms. 17 Section 2. Boundaries. The Plaza Frida Temporary Entertainment District boundaries 18 are the southwest corner of W. 65th Street and Scott Hamilton Drive(see attached map). 19 Section 3. Timeframe. The Plaza Frida Temporary Entertainment District will be 20 designated as a Temporary Entertainment District from June 20, 2026, through September 20, 2026. 21 The hours of operation for the Plaza Frida Temporary Entertainment District shall be Saturdays and 22 Sundays from 11:00 am to 9:00 p.m. per the days set forth as adopted by this ordinance. The City 23 reserves the right to amend boundaries and hours of operation at its sole discretion. 24 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, 25 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such 26 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain 27 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not 28 originally a part of the resolution. 29 Section 5. Repealer.
