Commission (Commission) on February 3, 2000, the Commission deferred the agenda item
concerning the unapproved asphalt paving of your properties located in the 900 Block of Scott
Street. Specifically, the driveways at 904, 908, and 920 Scott Street, the parking lot on the
Southwest corner of 9th Street and Scott Street, and the parking lot driveway on Scott Street are the
locations identified by the Commission.
As we have discussed, the asphalt paving of these areas was not approved by the
Commission, as is required pursuant to state statute and local ordinance. The design guidelines for
the MacArthur Park Historic District (District) provide that asphalt paving is not recommended and
must be approved by the Commission. In addition, the parking lot's asphalt driveway located on
Scott Street does not have a curb cut, which must be approved by the Commission as well.
You are requested to appear before the Commission on March 2, 2000, at 5:00 p.m. in the
Sister Cities Conference Room located in City Hall at 500 W. Markham, Little Rock, Arkansas.
Your appearance before the five -member Commission 1) will provide you with an opportunity to
address your actions on the above -referenced projects, and 2) will allow the Commission to review
the appropriateness of the projects for the District.
The Commission will specifically address the following issues: 1) lack of compliance the the
requirement of Certificate of Appropriateness, 2) street perspective of the driveways, 3) unapproved
asphalting, 4) landscaping, 5) failure to provide a curb cut. You should be prepared to discuss each
of these areas of concern at the Commission meeting.
The Commission has long-established procedures for material changes and physical
improvements for structures and sites in the District, of which you were aware prior to commencing
the above-refernced projects. The Commission is committed to upholding its responsibilities
pursuant to the local ordinance and design guidelines, and your continued failure to attend the
Commission's meeting may result in legal action being asserted against you on behalf of the
Commission.
