In regards to the West 72' of lot 7, block 45 Original City, known as 316 E 11th Street;
the East 68" of lot 7, block 45 Original City, known as 1020 Rock Street; and Lot 8, Block
45 Original City, known as 1016/1018 Rock Street.
The owners are is in violation the following sections of the city code:
At 1016/108 Rock Street:
They are in violation of Sec. 8-31. "Building permits and permit fees" for failing to obtain
a building permit for the fence that was installed before May 3, 2007 on the south
property line. A Certificate of Appropriateness was issued on May 14, 2007.
At 316 E 11 th Street:
They are in violation of Sec. 23-115. "Certificate of Appropriateness required" for failure
to make an application for a certificate of appropriateness for exterior changes to the
site, more specifically, a eight foot tall fence. They are also in violation of Sec. 8-31.
"Building permits and permit fees" for failing to obtain a building permit for the fence.
They are also in violation of 36-516 "Fences and walls" for erecting a fence that exceeds
the maximum height allowed. The applicants applied for a COA and a variance from the
Board of Adjustment on this site. The application was denied at the Historic District
Commission and the item for the Board of Adjustment was recommended to be
withdrawn by Staff because of denial by the HDC, non -response from the applicant and
the applicant not being present at the hearing.
Please remember that Sec. 23-78 Violations and Penalties states "...the person has a
maximum of thirty (30) days from the date of the order in which to abate the alleged
violation or to appear before the Historic District Commission..."
Please advise me when the courtesy notice has been served.
