This requirement ensures that all parties explicitly consent to representation before the Little Rock Planning Commission and Board of Directors by their chosen representative. This requirement is also explicitly outlined in the application instructions. Please note that while the affidavit template provided in the application may be used, it is not mandatory. If it does not fully suit the circumstances, any official affidavit authorizing representation will be acceptable. Given the nature of this annexation request, we have also sought clarification from the City Attorney’s Office. However, responses can sometimes be delayed. In light of the potential time required to collect the affidavits—as you noted—I wanted to inform you promptly so you may begin the process concurrently. Ideally, we would receive the affidavits by Wednesday, June 4 th, so that our staff report is accurate and complete. The hard deadline is the hearing date, June 12 th. I have confirmed that, in order to proceed with scheduling a hearing before the Planning Commission, we must first receive the fully executed court order from the county. Proceeding without this documentation would render any actions taken by the Planning Commission and Board of Directors procedurally out of order. If we did not receive this by the hearing date, we would simply defer the item to the July 10th PC meeting. Hopefully the order is executed between now and the June 12th date. AGIO plans to update their boundary to align with ours; however, their data is not scheduled for publication until the 15 th of the month. With that in mind, in the meantime, you can use our municipal boundary shapefile—attached—to begin revising the legal description for the annexation. Feel free to send that over when you have it or alongside the other requested submittal documents. You don't often get email from timmis@gill-law.com. Learn why this is important 4 AGIO also mentioned that they have not yet received this annexation request on their end. In our talks with Bryan Day, he was under the impression that this was already in the AGIO’s hands. With the aim of meeting the June 3rd deadline for submittals to be heard at the June 12th Planning Commission meeting, I’d just like to suggest that when the updated legal description is provided to them that y’all also confirm their receipt of all necessary documentation so they can begin processing. Lastly, since the City of Little Rock typically includes the phrase “INCLUDING ALL ADJACENT, ABUTTING AND TRAVERSING ROADS AND RIGHTS OF WAY OF RECORD.” in the legal descriptions within our ordinances, please be sure to include this language in the legal description you send to AGIO. This will ensure that the rights of way are incorporated into their annexation drawings and help prevent future discrepancies. Logan, I posed this question to Bryan Day but I think he skipped over it in a previous email, but you might know the answer. What is the preferred name of the annexation? This will serve as the reference name on the Planning Commission and Board agendas. I see the project title as “Project Boar” on document titles but just want to confirm this before setting the item for the June agenda. Please don’t hesitate to reach out if you have any questions.
