Gentlemen:
In accordance with your request for my converting the above mentioned
structure to storage, I hereby agree to the following stipilations.
a. This structure will no longer be used for living purposes.
b. I hereby agree to remove all plumbing fixtures with the exception of a
lavatory and stool.
c. If at any time I wish to convert this structure back to living quarters,
I will notify the Department of Community Development and I will bring
this structure into full compliance with the Minimum Housing Code.
d. I also agree to paint the exterior of this structure if needed and do
other repairs that are necessary to upgrade the appearance of the
exterior of this structure.

Information obtained by our office' indicates that you are the owner/agent of
the above referenced property.
This is to advise you that an inspection was made on the above referenced
property and/or structure. It was determined by this inspection that this
dwelling is hereby condemned as unfit for human habitation, offensive to the
neighborhood, dangerous to the lives, .limbs and property of persons in its
vicinity or lawfully passing thereby, and is in violation of Ordinance No.
13,304. Pursuant to the provisions of Ark. Stat. Ann. SS 14-56-203, 14-56-302
and the Little Rock Code of Ordinances, Chapter 20, S 20-26 and SS 20-32 et
seq., this structure is hereby declared by the Department of Public Works
as a nuisance by reason of being unsightly, unsafe, unsanitary, obnoxious
and is detrimental to the public welfare of the citizens of Little Rock.
In accordance with the Little Rock 'Housing Code, SS 20-28 et seq., you have
thirty (30) days to either initiate repairs or demolish this dwelling. Should
you fail to comply with this requirement, the City will initiate legal proceedings
against you and/or the property.
This dwelling is now vacant and is not to be occupied until repairs are made
and approved by the Housing Code Enforcement Office.
You are requited to secure this dwelling and/or structure in an approved
manner within ten (10) days. Failure to secure all accessible windows, doors
and/or openings within the allotted time will result in the City taking
appropriate action to have this accomplished and the owner will be responsible
for all incurred costs. The owner is responsible for maintaining the security ,
of this dwelling and/or structure until all code requirements have been met���oe+6r+

Please be advised that neither the issuance of a repair permit, or a permit
for the demolition of this structure, or an extension of time granted by the
Department of Public Works, relieves the owner of the responsibility to secure
the structure.
Should you feel the application of this code causes an undue hardship, or
that the regulations have been misconstrued or wrongly interpreted, you have
thirty (30) daysin which to appeal this inpsection to the Housing Board of
Adjustment and Appeals.
All necessary permits must be obtained from the Permits Section of the Department
of Public ►rJorks, located at 723 West Markham Street.

hours of 8 a.m. and 5 p.m., Monday through Friday.

The following is a list of needed repairs for the condemned vacant structure
located at 815 South Rock Street, Little Rock, AR:
LIVING ROOM, DINING ROOM, FRONT ENTRYWAY, ETC.
Floors:
Replace all rotted flooring, subflooring
and floor joists.
Repair floors to be reasonably level.
Properly finish or install new covering.
Repair or replace baseboard and shoe mold
and properly finish.
Walls:
Repair or replace termite -damaged wall
studs and plates.
Replace damaged wall covering.
Ceilings:
Repair or replace rotted and termite -damaged
ceiling joists.
Replace ceilings where damaged or destroyed.
Heat & Gas Piping:
Install shutoff valves on gas risers.
Install adequate heating facilities.
Doors:
Repair and refinish all doors.
Repair jambs, casings and facings of all
doors and refinish.
Install weatherstripping on all exterior
doors.
Windows:
Most window casings are termite -damaged
and/ -or rotted. Sashes are deteriorated,
with many windows broken or missing.
Recommend replacement of windows with complete
new units.
BEDROOMS. HALLWAYS, STAIRWELLS, ETC.
Floors: Replace all rotted flooring, subflooring
and floor joists.
Repair floors to be reasonably level.
Properly finish or install new covering.
Repair or replace baseboard and shoe mold
and properly finish.
Repair stairs to be sound and provide non -slip
finish or covering on treads. Southeast
rear stairs are deteriorated and dangerous.
Walls: Repair or replace termite -damaged wall studs
and plates.
Replace damaged mall covering of all areas.
Ceilings: Repair or replace rotted and termite -damaged
ceilings joists.
Replace ceilings where damaged or destroyed.
Heat & Gas Piping: Install shutoff valves on gas risers.
Install adequate heating facilities.
Doors: Repair and refinish all doors.
Repair jambs, casings and facings of all
doors and refinish.

doors.

Must have window openable for ventilation
or install approved mechanical ventilation
device (fan).
KITCHEN

Repair floors to be reasonably level.
Install water -impervious floor covering.
Repair or replace baseboard and shoe mold
and properly finish.
Malls: Repair or replace termite -damaged wall studs
and plates.
Replace damaged wall covering.
Ceilings: Repair or replace all rotted and termite -
damaged ceiling joists.
Replace ceiling where damaged or destroyed.
Porches & Steps: All porches, including front (west) porch,
arb,badly rotted, deteriorated and dangerous.
North (rear) porch is missing. Reconstruct
all porches, steps, railings, etc. to Southern
Building Code Standards and properly finish
to be resisitant to weather.
Miscellaneous Comments: Structure is located in the MacArthur Park
Historic District.

An open letter, to Charles Nickerson, City Manager,

Dear, Mr. Nickerson:
This is to advise you that 815 Rock Street is a
dangerous building. We sk that you bring tt.;o or three
city building inspectors -- people who know what
they're looking at with construction -- and tour this
building.
If someone is ever injured in or by this building,
'`. that could have serious legal implications which the
city may not be able to avoid. Efforts on our, part to
sell this structure have failed. We have advised the
city twice that we do not have the financial resources
to refurbish this structure. Given our three medical
situations, our future is too uncertain and our assets
are too limited to allow our donating this property or
accepting "give away" prices for- it. The city condemned
this building three years ago as unsafe and informed us
that we had to demolish or refurbish it. Given our
limited resources, refurbishing was out of the
question. We applied for demolition with which we were
fully willing to comply, but the city has refused this
request twice.
The city is empowered by Ordinance No. 13,154
Section 5C, Nos. 1 - 5, to find alternatives to
demol i ti on. There has been no ,attempt to exer•ci se these
options. The city made no attempt o-n the second request
to appraise the condition and therefore the safety of
this structure. In fact there was no report of staff
findings and recomendations prior to our presentation
on Dec 2, 1993 --s.is required in the Little Rock
Historic District Commission bylaws, Article- 5, Section
6, No. 2. The city has chosen to ignore its own
condemnation of this building, the recommendation for
demolition by the Arkansas Historic Preservation
Program, and the assessment of the condition of this
structure and refurbishing estimate by Brownlee

faith that this will result in a sal::. We've had too
many people look at 815 Rock Street when the building
was in far• better• shape. only if we were willing to
take a financial beating would we have ever, been able
to sell it.
