Establishment of District. There is hereby established a municipal property owners' 16 multipurpose improvement district within the Property described on Exhibit"A,"to be known as Kenwood 17 Project Multipurpose Improvement District No. 2026-002 of Little Rock,Arkansas(the"District"). 18 Section 2. That the legal description of the real property to be encompassed within this District is 19 described attached as Exhibit"A": 20 Section 3. Purposes and Powers. The District is established for the following purposes,as authorized 21 by applicable law: 22 1. Acquiring and purchasing equipment and machinery incident to the operation and maintenance of 23 improvements; 24 2. Performing any and all acts deemed necessary to purchase,construct,accept as a gift, operate,and 25 maintain any and all improvements; 26 3. Providing fire protection services for the District; and, 27 4. Doing all things now or hereafter permitted under applicable law, including without limitation 28 Arkansas Code Annotated § 14-94-101 et seq., to be done and performed by municipal property 29 owners' improvement districts. 30 The District shall have and may exercise the power of eminent domain as authorized by law to carry out its 31 purposes. 32 Section 4. Commissioners. The following individuals,whose names appear in the petition,are hereby 33 appointed as Commissioners and shall constitute the Board of Improvement of the District: 34 • Joseph Park 1 • Lucille Im 2 • Sung Kyoo Park 3 Section 5. Findings of Necessity. The Board of Directors finds and declare that there is an immediate 4 need within the City of Little Rock, Arkansas, for the improvements described in this Ordinance and that 5 the creation of the municipal property owners' multipurpose improvement district established herein is 6 necessary and is the only feasible means by which such improvements may be accomplished. 7 Section 4. That the name of the Improvement District shall be The Kenwood Project Multipurpose 8 Improvement District No. 2026-002. 9 Section 5.Severability. In the event any portion of this ordinance is declared or adjudged to be invalid 10 or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this 11 ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or 12 unconstitutional was not originally a part of this ordinance. 13 Section 6. Emergency Clause. It has been found and it is hereby declared by the Board of Directors 14 that there is an immediate need within the City of Little Rock, Arkansas,for the improvements described 15 above in this Ordinance and that the creation of the municipal property owners' improvement district 16 created hereby is the only means whereby these improvements may be accomplished, which is necessary 17 for the immediate preservation of the public health, safety, and welfare, shall be in force and take effect 18 immediately upon and after its passage. 19 Section 7. Repealer.
