CASE NO. 94-344
Bill Hylton who represents the Plaintiffs in the
above -referenced action has scheduled your depositions for
Friday, September 9, 1994. Molly's deposition is set for 9:00
a.m. and Jim's is set for 10:00 a.m. The depositions will be
taken in the Conference Room in the City Attorney's Office.
Attached to this memo is part of a letter which I received
from Mr. Hylton in which he lists certain files he would like
for you to bring to the depositions. I have informed Mr.
Hylton that you will not require a subpoena for your
attendance at the depositions.
Molly, Mr. Hylton also intends to depose all the
members of the Historic District Commission. I felt unable to
promise the attendance of these individuals without the
issuance of a subpoena. However, I did tell Mr. Hylton that
it would probably be unnecessary to submit the standard $35
witness fee. I would appreciate it if you would let the
Commission members know they will be receiving subpoenas for
depositions on September 9, 1994. I would also appreciate it
if they would agree to be deposed without requiring the
payment of the witness fee. At some point, in either
settlement or trial, fees and costs may become an issue and I
don't see the need to run up the costs in this lawsuit in the
event the City may be required to reimburse a portion of
those amounts.

know.
