Two. APPLICANT: Judge Alice Lightle ADDRESS: 614 Rock Street COA REQUEST: Fence PROJECT BACKGROUND AND DESCRIPTION: The subject property is located at 614 Rock Street. The property's legal description is "Lot 2, MacArthur Place Addition, City of Little Rock, Pulaski County, Arkansas." This lot is a vacant lot. It is considered "Non - Contributing" to the MacArthur Park Historic District. The application for a Fence will enclose part of the lot that faces Rock Street. The existing fence will be moved to the east. PREVIOUS ACTIONS ON THIS SITE: On October 8, 2007, a COA was approved and issued to Tina Boyd for the construction of a new house. This house was never constructed. ]Rti tryr CAP'WL j jf'' } i I2I4 'S09 fVr� rsr". �f .rrH a Location of Project PROPOSAL AND WRITTEN ANALYSIS OF THE APPLICATION BASED OFF OF INTENT AND GUIDELINES: Currently, there is a fence that starts at the western edge of the garage and goes north across the lot of 614 Rock (a vacant lot). The proposal is to move that fence 54' to the east and align the fence with the western edge of the house at 618 Rock and then go north to connect with the fence already erected at the north side of the property line. The proposed fence will be near the back of the property. It will be a 6' tall fence with a pedestrian gate to access the rest of the property at 614 Rock. One shared driveway serves all three properties: 614 Rock, 618 Rock and 617 Cumberland. 1 of 5 Aerial view. The Guidelines state on page 66: Wood board privacy fences should be located in rear yards. They should be no taller than six feet (72"), of flat boards in a single row (not stockade or shadowbox), and of a design compatible with the structure. The privacy fence should be set back from the front fagade of the structure at least halfway between the front and back walls. Staff believes that the proposed fence is in conformance with the Guidelines. NEIGHBORHOOD COMMENTS AND REACTION: At the time of distribution, there was one comment in support of this application. STAFF RECOMMENDATION: Approval with the following conditions: 1. Obtaining a building permit. COMMISSION ACTION: May 14, 2012 Brian Minyard, Staff, made a brief presentation to the Commission. Commissioner Julie Wiedower asked if the fence that was approved recently the fence that was across the shared driveway. Mr. Minyard stated yes. Deborah Willhite, an owner of the property, stated the reasons for moving the fence was for more are of the dogs. There are no plans for anything else at the time. Commissioner 2of6 Wiedower asked if it was to the midpoint of the house on Rock. Ms. Willhite said that it was not, it was to the back corner of that house. Mr. Minyard stated that there was a letter of support on this item form Conner Limerick, an adjacent property owner. Katherine Matthews stated she was in favor of the application. Debra Weldon, of the City Attorney's office, reminded the Commission that in the case of five or less commissioners present, that the applicant is offered a deferral. Chairman Chris Vanlandingham offered a deferral to the applicant, but she wished to hear Commissioner Wiedower's question. Commissioner Wiedower asked if the fence was to be relocated or portions of it to be reused? Should it be in the rear of the lot since there is not a structure on that lot? Commissioner Wiedower encouraged the applicant to install shrubbery to make less conspicuous. Commissioner Wiedower made a motion to approve as submitted. Commissioner BJ Bowen seconded. Markham St. Little Rock, AR 72201 To Whom It May Concern: I am submitting this letter in conjunction with an Application for a Certificate of Appropriateness for proposed changes adjacent to 614 Rock Street. I live at 617 Cumberland Street, and I also own the property adjoining mine that is located at 614 Rock Street. This property is a vacant lot that has a business, AnswerFone, to the north and a residence to the south. There is a privacy fence with a gate that separates the back of my Cumberland property from this Rock Street property, and I would like to move this fence forward on the Rock Street Property. This would provide a yard with room for a garden. The residence behind me, 618 Rock Street, has privacy fencing that extends 54 feet from mine. I would like to relocate my fence that same distance toward Rock Street, connecting to the end of my neighbor's fence and to the privacy fence that extends along the north side of the property. This width would be a distance of 45 feet, and the neighbors are in agreement with this plan. The fence will be made of ACQ treated pine. It will be 6 feet tall, the same height as the two fences to which it will adjoin, with a cap and trim box post. We will also include a locking gate that will open to the Rock Street property. I will submit further documentation, including pictures and a drawing of the work to be performed by the April 161h deadline. Please let me know if you require further information. Sincerely.
