Justification: The applicant’s justification was submitted with the application. STAFF REPORT Planning and Development Civil Engineering Comments: No Comments B. Buffering and Landscape Comments: In October 2020 the City adopted the “Heights Landscape Design Overlay District,” requiring installation of one tree per 40 linear feet of street frontage within the Heights District Boundary, applicable to [among other types] residential construction in excess of 600 square feet. C. Building Codes Comments: No Comments. D. Staff Analysis: The R-2 zoned property at 5308 Country Club Blvd. is located within the Heights Landscape Design Overlay District, within the Newtons Addition subdivision just west of Harrison Street on the north side of Country Club Blvd. The applicant states that they have purchased the properties at 5304 and 5308 Country Club Blvd., with the intent of creating a single lot with a single-family dwelling. The applicant further states that as part of this proposal, the rear (north) portion of the existing dwelling at 5305 Country Club Blvd. will be demolished, retaining the front portion of the façade, thus maintaining the character of the neighborhood. Additionally, that applicant states their intent is to seek a replat from the Little Rock Planning Commission to create one single lot. Included within this overall proposal the applicant intends to construct an addition to the north, followed by the demolition of the existing dwelling at 5304 Country Club Blvd. and an eventual expansion of 5305 Country Club Blvd to the east. The survey and sketches provided by the applicant indicate that the new construction will extend north thirty (30) feet and to the east eight (8) feet to within one (1) foot of the existing property line shared with 5304 Country Club Blvd.. Due to the proximity of the dwelling expansion to the property line and the existing residence at 5304 County Club Blvd., the addition will be required to adhere to the International Building Code fire rating standard, along the east side. Once the new construction/expansion to 5308 Country Club Blvd. is completed, a replat of the two properties must be sought along with a demolition permit for 5304 Country Club Blvd. Section 26-255(d)(2) states, “There shall be a side yard on each side of the building having a width of not less than ten (10) percent of the average width of the lot, not to exceed five (5) feet. Therefore, the applicant is requesting a variance to allow the rear yard setback to be reduced to not less than 4 feet. Staff believes that the variance request is reasonable. It is staff’s opinion that the existing conditions along with the applicants effort to retain the front façade of the residence and maintain front streetscape of the area and not detract from the value or aesthetic of the neighborhood or surrounding properties. E. Staff Recommendation: Staff recommends approval of the requested east side yard setback reduction to a minimum of one (1) foot as outlined in the above staff analysis and on the provided sketch with the following conditions: 1. A building permit being obtained for all construction. 2. All regulations in the Heights Landscape Design Overlay District must be adhered to. 3. Construction means and methods, adhere to current International Building Code and the City of Little Rock Building Code. 4. Demolition of 5304 Country Club Blvd. must be complete prior to Certificate of Occupancy being issued for 5308 Country Club Blvd. 5. A replat of the property being performed and filed with the Little Rock Planning and Development Department prior to building permit being obtained for the remainder of construction on 5304 Country Club Blvd.
