HomeMy WebLinkAbout22766 1 ORDINANCE NO. 22,766 2 3 AN ORDINANCE TO AUTHORIZE THE DEMOLITION AND REMOV- 4 AL OF ELEVEN (11) UNSAFE AND DILAPIDATED RESIDENTIAL 5 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 6 PURPOSES. 7 8 WHEREAS,the City has inspected certain residential structures and determined that they are unsafe, 9 unfit for human habitation,and constitute a danger to life, safety,and property; and, 10 WHEREAS, said structures are severely dilapidated, deteriorated, and/or fire-damaged, creating 11 blight and a negative environmental impact on the surrounding residential neighborhoods;and, 12 WHEREAS, the owners of said properties have either abandoned the structures, failed to bring them 13 into compliance after proper notice,or requested demolition by the City; and, 14 WHEREAS, all required notices have been properly mailed and served in accordance with Arkansas 15 State Law; and, 16 WHEREAS,the City finds that demolition and removal of these structures is necessary to protect the 17 public health, safety,and welfare; and, 18 WHEREAS, the estimated total cost for demolition and removal of the eleven (11) structures is 19 Eighty-Two Thousand Five Hundred Dollars ($82,500.00), to be charged to Demolition Account No. 20 108359. 21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 22 OF LITTLE ROCK,ARKANSAS: 23 Section 1. The Board of Directors hereby authorizes the demolition of the eleven (11) structures 24 identified in Exhibit A for a total amount not to exceed Eight-Two Thousand Five Hundred and 00/100 25 Dollars($82,500.00) 26 Section 2. Funds for this program are available from Demolition Account Number 108359. The City 27 is authorized to assess all costs, including administrative and lien amounts, against the respective proper- 28 ties and to take appropriate action to recover such costs in accordance with Arkansas law. 29 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 30 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adju- 31 dication shall not affect the remaining portions of this resolution, which shall remain in full force and ef- 32 fect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 33 resolution. All laws,ordinances and resolutions that are inconsistent with the provisions of 2 this resolution are hereby repealed to the extent of such inconsistency. 3 Section 5.Emergency Clause.
