3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A MEMORANDUM OF AGREEMENT WITH PULASKI COUNTY,
5 ARKANSAS, REGARDING PHASES 8 AND 9 OF THE SOUTHWEST
6 TRAIL; AND FOR OTHER PURPOSES.

8 WHEREAS,the City of Little Rock supports the development of multi-use trails that promote safe
9 pedestrian and bicycle transportation,recreation,and regional connectivity; and,
10 WHEREAS,Pulaski County,Arkansas,is developing the Southwest Trail,a shared-use pedestrian
11 and bicycle trail intended to ultimately connect Hot Springs,Arkansas,to Little Rock Central High School;
12 and,
13 WHEREAS, Phases 8 and 9 of the Southwest Trail will extend the trail from Roosevelt Road to
14 Little Rock Central High School variously on land owned by the City adjoining Thayer Street within the
15 City of Little Rock inside the eastern side of the Jones Street right-of-way granting a temporary right of
16 entry onto City property to the county for such purposes, and approving the design and placement of such
17 improvements as set out in the property description herein as Exhibit A;and,
18 WHEREAS, these phases represent a continuation of the recently completed segment of the
19 Southwest Trail extending from the Saline County Line to Hilaro Springs Road; and,
20 WHEREAS, Pulaski County, Arkansas, will bear all costs associated with the development and
21 construction of Phases 8 and 9 of the Southwest Trail, and there is no fiscal impact to the City of Little
22 Rock for the construction of these phases;and,
23 WHEREAS, Pulaski County, Arkansas, will retain ownership of the constructed trail until the
24 expiration of the construction maintenance bond for that portion of the trail; and,
25 WHEREAS,upon expiration of the maintenance bond,Pulaski County will transfer ownership of
26 the trail to the City of Little Rock, at which time the City will assume responsibility for the long-term
27 maintenance of the trail;and,
28 WHEREAS, a Memorandum of Agreement between the City of Little Rock and Pulaski County,
29 Arkansas, is necessary to define the responsibilities of the parties regarding the construction, ownership,
30 and future maintenance of Phases 8 and 9 of the Southwest Trail.
31 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
32 CITY OF LITTLE ROCK,ARKANSAS:

1 Section 1.The City Manager is hereby authorized to enter into a Memorandum of Agreement with
2 Pulaski County,Arkansas,regarding the development and construction of Phases 8 and 9 of the Southwest
3 Trail,extending from Roosevelt Road to Central High School.
4 Section 2.The Memorandum of Agreement shall provide that Pulaski County,Arkansas,will bear
5 all costs associated with the development and construction of Phases 8 and 9 of the Southwest Trail.
6 Section 3. Pulaski County, Arkansas, shall retain ownership of the trail upon completion of
7 construction until the expiration of the construction maintenance bond for that portion of the trail.
8 Section 4. Upon expiration of the maintenance bond, Pulaski County, Arkansas, shall transfer
9 ownership of the trail to the City of Little Rock, which shall thereafter be responsible for the long-term
10 maintenance of the trail.
11 Section 5. Funding for the construction of Phases 8 and 9 of the Southwest Trail shall be provided
12 entirely by Pulaski County, Arkansas, and this Resolution has no fiscal impact on the City of Little Rock
13 for the construction of these phases.
14 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
15 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
16 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
17 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
18 resolution.
19 Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
20 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.

A ten-foot wide, two-way sidepath in the right-of-way along the east side of
Jones Street from where the easement described in "Section a." on the City of
Little Rock parcel abuts the southern terminus of the Jones Street right-of-
way to the intersection of 16th street, including a required partial street
widening and the development of the sidepath on the eastern side of Jones
Street as shown in Exhibit A hereto attached and as shown in final engineered
plans to be endorsed by Little Rock Public Works.
A ten-foot wide,two-way cycle track on the surface of Jones Street against the
eastern curb north of the intersection of 16th Street to the intersection of Daisy
Gaston Bates Drive turning east and continuing on the surface of Daisy Gaston
Bates Drive against the southern curb to a point beyond the residential housing
on the north side of Daisy Gaston Bates Drive, crossing at a midblock to the
northern curb,thence east to the intersection of Daisy Gaston Bates Drive and
Little Rock Nine Way/Park Street,as shown in Exhibit B hereto attached and
as shown in final engineered plans to be endorsed by Little Rock Public Works.
This portion of the pathway will not be included on the initial construction
project.
