The tenant if the Property is the Ismaili Jamatkhana church (the “Church”) at that location, which is zoned O-1. The Church was established for its religious practices and for organized educational, cultural, and social programs open to the wider society and its physical church is intended to exhibit natural light, and gardens, reflecting spiritual concepts and creating a harmonious environment for contemplation and community. My clients object to the rezone from O-1 to C-2 as potentially changing the consistency of the neighborhood. My client’s property lies immediately to the East of the property that is the subject of the rezoning and land use change. Most of the parishioners attending the Church are young people with children who enjoy the relative peace and safety of the current neighborhood for that part of Kanis Road which consists of residential and quiet office use. There is a church across the street and residential neighborhoods abutting both the subject property and my client’s property. The proposed change to retail use will likely lead to an increase in traffic and potential hazards on local streets immediately next to the property, and may include businesses which may sell marijuana and alcoholic beverages which would be inconsistent with the faith of the Church. Further, the proposed change is illegal "spot zoning," which is the practice of singling out a specific parcel of land for a zoning change that is different from the immediately surrounding area. The current zoning in the immediate area was a selling point made to my clients at the time it was acquired from the developer of the property, including the property that is applying for rezoning in the subject filings. Department of Planning and Development September 9, 2025 Page 2 _________________________________ The proposed rezoning stands for proposed changes which are inconsistent and incompatible with the existing uses and may permit a broad range of uses, either with or without a conditional use, which are especially inconsistent and will negatively affect the quality of immediate area due to increased noise, litter, and other nuisances for many of the permitted uses und C-1 usage.
