3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A
5 ONE (1) YEAR ADVANCED PURCHASE ORDER CONTRACT
6 EXTENSION WITH RIVER CITY HYDRAULICS, INC., IN AN AMOUNT
7 NOT TO EXCEED FIVE HUNDRED THOUSAND DOLLARS($500,000.00),
8 INCLUDING APPLICABLE TAXES AND FEES, FOR HEIL PARTS AND
9 SERVICE FOR HEIL HEAVY EQUIPMENT AND MACHINERY IN
10 CITY'S FLEET, TO DECLARE AN EMERGENCY; AND FOR OTHER
11 PURPOSES.

13 WHEREAS,it is a necessity for Fleet Services to be equipped with reliable parts and services for minor
14 maintenance and repair of Heil heavy equipment and machinery in the City's Fleet to ensure readiness to
15 respond to Public Works needs in the City;and,
16 WHEREAS, River City Hydraulics, Inc. is the only authorized Heil dealer that can provide parts and
17 service for Heil equipment in the Central Arkansas area.; and,
18 WHEREAS, Little Rock,Ark. Ordinance No 22,609 (May 6, 2025), authorized the initial one-year
19 contract term with an option to extend the contract for up to two(2)additional one(1)year terms;and,
20 WHEREAS, the City's Fleet Services Department wishes to exercise the option to extend the Heil
21 Parts and Service Advanced Purchase Order Contract for a second, one (1)-year term of the three (3)
22 previously authorized extension per the above-referenced resolution;and,
23 WHEREAS,the total cost of a second one(1)-year extension of the Heil Parts & Services Advanced
24 Purchase Order Contract with River City Hydraulics, Inc., is in an amount not to exceed Five Hundred
25 Thousand Dollars($500,000.00), including applicable taxes and fees.
26 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
27 OF LITTLE ROCK,ARKANSAS:
28 Section 1.The Board of Directors declares it impractical and unfeasible to acquire this annual parts and
29 service contract through the competitive bid contract.
30 Section 2. The Board of Directors hereby authorizes the City Manager to enter into a one (1) year
31 extension of Heil Parts& Services Advanced Purchase Order Contract with River City Hydraulics, Inc., in
32 an amount not to exceed Five Hundred Thousand Dollars ($500,000.00), including applicable taxes and
33 fees.

1 Section 2.Funds for this contract are allocated in the Fleet Maintenance Account Nos.: 600031-63371 &
2 600036-63372 and Fleet Parts Account No.600013-60310.
3 Section 3.Severability.In the event any title,section,paragraph,item,sentence,clause,phrase,or word
4 of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
5 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the
6 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
7 Section 4.Repealer.All laws, ordinances, resolutions,or parts of the same,that are inconsistent with
8 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
9 Section 5. Emergency Clause. There is hereby found and declared to be an immediate need for
10 availability and purchase Heil Parts&Services for City equipment which benefits the public health, safety,
11 and welfare of the City and the inhabitants thereof. It is therefore declared that an emergency exists and
12 this Ordinance, being necessary for the immediate preservation of the public health, safety, and welfare,
13 shall be in force and take effect immediately upon and after its passage.
