HomeMy WebLinkAbout17012 1 RESOLUTION NO. 17,012 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR TO ACCEPT, FOR 4 MUNICIPAL PURPOSES, PERMANENT CONSTRUCTION 5 EASEMENTS, RIGHT-OF-WAY DEDICATIONS, AND FEE-SIMPLE 6 ACQUISITIONS, AND TO AUTHORIZE THE CITY MANAGER TO 7 ACQUIRE TEMPORARY CONSTRUCTION EASEMENTS AS NEEDED 8 TO COMPLETE THE CONSTRUCTION OF THE MARKHAM STREET 9 IMPROVEMENTS PROJECT,AND FOR OTHER PURPOSES. 10 11 WHEREAS, Little Rock,Ark., Resolution No. 16,052 (July 18, 2023), expressed the willingness 12 of the City of Little Rock, "City", to utilize Federal-Aid Surface Transportation Program Funds from 13 Metroplan for Markham Street Improvements from South Cedar Street to Pearl Avenue; and, 14 WHEREAS, on October 14, 2024, the City of Little Rock was notified by Metroplan that it had 15 been awarded $1,075,000 in CARTS 2025 Surface Transportation Block Grant Funds for construction of 16 the Markham Street project;and, 17 WHEREAS,the acquisition of Easements,Right of Ways,and Fee Simple Acquisitions is needed 18 to accomplish the construction,maintenance,and continued public access to the street improvements. 19 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK,ARKANSAS: 21 Section 1. The City Manager is authorized to pursue the acquisition of Permanent Construction 22 Easements, Drainage Easements, Right-of-Way Dedications, Fee Simple Acquisitions, and Temporary 23 Construction Easements as needed to complete the Markham Street Improvements project. 24 Section 2. The Mayor is authorized to accept Permanent Construction Easements, Right-of-Way 25 Dedications, and Fee Simple Acquisitions for municipal purposes, and the City Manager is authorized to 26 accept Temporary Easements needed for construction. 27 Section 3. Funding for this project is from Street Fund Special Project Activity S40B63 1. 28 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 29 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 30 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 31 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 32 resolution.
