Dear Sirs:
The Eastside Auditorium is located on a site which is at the heart of a residential area which has a stability
which that can best described as delicate, This area is rather small, now only a few city blocks wide in
both directions bound by Main Street, 1H-630, and the strip of lots made vacant by the tornado. Due to its
central location, it is crucial that the development ofthe Auditorium site and grounds be very sensitive to
its surroundings. The site plan which was submitted February 1, 2005, however, does not indicate this
concern.
We wish to make two points concerning the submitted Site Plan, First of all, a review ofthe site is not
yet possible since submitted plan is incomplete per the requirements listed on the Application Form.
Second, the submitted site plan is not in compliance with important portions of applicable codes.
1. The Site Plan is not complete (see attachment 1). As stated on the Form the Plan should have
also included for review and approval driveways, fencing, lighting, security gates, mechanical
equipment or dumpsters and required screens, and any and all other improvements.
2. The site plan submitted with the Application is not in compliance with the following
applicable codes (Note: All codes must apply since a Conditional Use Permit only allows for
a change of use):

applicants stated at both the Mansion Area Advisory Committee Meeting on March 29 and at
the Public Hearing on March 31 that they will save the trees on north side .ofthe property in
the area ofthe parking lot. Per the City ofLittle Rock -Landscaping and Tree Protection
Ordinance, Section 15-52 (see attached ordinance), trees selected for preservation must have
the area within the dripline fenced and protected from development (the parking lot and most
all other work must stay outside of this area). Also, if any tree is within the public right-of-
way, Section 15-51 does not allow its removal. It must be protected from development per
the requirements mentioned above.
B. Parkin cannot be within the re uired setbacks. Per the Zoning Requirements for the Capitol
Zoning District, page 3, all residential zones are required to have at least a 25 That setback (up
to a minimum of 15 foot where historic precedence exists on the block). Also, Section 15-96
ofthe City of Little Rock Landscaping and Tree Protection Ordinance has an overlapping
requirement for a 9 foot wide perimeter planting strip.
To reduce the impact of the parking and site development on the surrounding residential neighborhood,
we wish to request that the Commission require as part of the Application and Conditional Use Permit the
following:
1 Existing trees shall remain and be protected per Capitol Zoning Ordinance and the City of Little
Rock Landscaping and Tree Protection Ordinance.
2. The total number of parking spaces on site for both buildings shall be kept to the minimum
required by code. There may be a surplus of parking on the south side of the site.
3. A Iandscape plan.

Light levels shall be in accordance with the General Standards for the Capitol Zoning District,
P.13, Parking Lot Lighting Standards. Of special concern are the requirements to avoid "light
trespass" for the adjacent property owners and public right-of-way.
