3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN
5 ANNUAL ADVANCE PURCHASE ORDER CONTRACT WITH BANNER
6 FIRE EQUIPMENT, INC., IN AN AMOUNT NOT TO EXCEED AN
7 ANNUAL BUDGET OF THREE HUNDRED THOUSAND DOLLARS
8 ($300,000.00),PLUS APPLICABLE TAXES AND FEES,FOR E-ONE PARTS
9 AND SERVICE FOR E-ONE FIRE TRUCK EQUIPMENT IN THE CITY'S
10 FLEET SERVICES DEPARTMENT;AND FOR OTHER PURPOSES.

12 WHEREAS, it is necessary that Fleet Services be equipped with reliable parts and services for minor
13 maintenance and repair of E-One equipment in the City's Fleet Services Department;and,
14 WHEREAS, Banner Fire Equipment, Inc. is the only authorized E-One dealer that can provide parts
15 and services for E-One fire truck equipment in the Central Arkansas area.; and,
16 WHEREAS, this new contract is for one(1)year,with the option to renew for up to two(2)additional
17 one-year terms.This represents year one(1)of a possible three(3)year contract;and,
18 WHEREAS, the Annual Budget to enter into a new advance purchase order contract with Banner Fire
19 Equipment, Inc. for E-One Parts & Services is not to exceed Three Hundred Thousand Dollars
20 ($300,000.00), including applicable taxes and fees.
21 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
22 OF LITTLE ROCK,ARKANSAS:
23 Section 1.The city dispenses with a competitive bid process because it is impractical and unfeasible to
24 bid on this purchase,as there is only one dealer within the Central Arkansas area.
25 Section 2.The Board of Directors hereby authorizes the City Manager to enter into a one(1)year advance
26 purchase order contract with Banner Fire Equipment, Inc., in an annual budget amount not to exceed Three
27 Hundred Thousand Dollars ($300,000.00), including applicable taxes and fees, for the purchase of E-One
28 parts and services for the E-One Fire Truck Equipment in the City's Fleet Services Department.
29 Section 3.Funds for this annual parts and service contract are allocated in various Fleet Maintenance and
30 Parts Accounts.
31 Section 4.Severability.In the event any title,section,paragraph,item,sentence,clause,phrase,or word
32 of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration or adjudication

1 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the
2 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
3 Section 5.Repealer.All laws, ordinances, resolutions, or parts of the same,that are inconsistent with
4 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
