On October 1, 1998, the Little Rock Historic District Commission ("Commission") held a
public hearing concerning the unauthorized application of artificial siding to the structure located
at 1417 Cumberland owned by Dr. Myra Ash. During the hearing, Dr. Ash informed the
Commission that you had installed the artificial siding to the structure pursuant to an oral contract.
The purpose of this letter is to advise you, on behalf of the Commission as its legal counsel,
that all structures located in the MacArthur Park Historic District ("District") are subject to the
jurisdiction of the Commission. Although Dr. Ash confirmed that she had advised you that her
property is located within the District, neither Dr. Ash nor you, as her contractor, applied to the
Commission for a Certificate of Appropriateness prior to the installation of the artificial siding. In
addition, and more significantly with respect to your capacity as a Class 2 Contractor, you failed to
obtain a building permit for this project from the Department of Planning and Development
("Department').
As a result of the hearing, the Commission initiated the process by which Dr. Ash will be
cited by Little Rock Code Enforcement for non-compliance with Commission procedures. Your
participation in the circumvention of the District's procedures has been forwarded to the Department
for appropriate action.
