3 AN ORDINANCE TO ABANDON AND VACATE CERTAIN PUBLIC
4 RIGHTS-OF-WAY,INCLUDING A PORTION OF WEST 41ST STREET,A
5 PORTION OF LONGCOY STREET, AND PORTIONS OF TWO (2)
6 ALLEYS LOCATED NEAR THE SOUTHEAST CORNER OF JOHN
7 BARROW ROAD AND WEST 40TH STREET, IN THE CITY OF LITTLE
8 ROCK,ARKANSAS (G-23-498); AND FOR OTHER PURPOSES.

10 WHEREAS,a petition has been filed with the City Clerk of the City of Little Rock requesting that
11 the Board of Directors abandon certain public rights-of-way as part of proposed development; and,
12 WHEREAS,the Board of Directors has determined that the rights-of-way described below are no
13 longer needed for public purposes and that abandonment thereof will not adversely affect public
14 interest; and,
15 WHEREAS, notice of a public hearing was given in the manner prescribed by law, and a public
16 hearing was held before the Board of Directors at which all interested persons were given an
17 opportunity to be heard.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
19 CITY OF LITTLE ROCK,ARKANSAS:
20 Section 1.Abandonment of Rights-of-Way.The following described public rights-of-way located
21 at the John Barrow Addition to the City of Little Rock,Arkansas, are hereby vacated and abandoned:
22 1. Approximately 288 linear feet of a ten-foot (10') wide alley extending from West 40th Street
23 to West 41st Street(Block 157,John Barrow Addition);
24 2. Approximately 288 linear feet of right-of-way known as Longcoy Street extending from West
25 41st Street to West 40th Street;
26 3. Approximately 135 linear feet of West 41st Street extending east from John Barrow Road,
27 between Lot 12, Block 157 and Lot 7, Block 158,John Barrow Addition; and
28 4. Approximately 50 linear feet of a ten-foot(10')wide alley located between Lots 6 and 7,Block
29 132,John Barrow Addition.
30 Section 2. Conditions. This abandonment is subject to the rights of any public utility or
31 governmental entity that may have facilities located within the above-described rights-of-way,and any
32 such entities shall retain the right to maintain,repair,and replace existing facilities as necessary,unless
33 otherwise agreed in writing.
