HomeMy WebLinkAbout22738 1 ORDINANCE NO. 22,738 2 3 AN ORDINANCE TO CREATE THE CHENAL VALLEY MUNICIPAL 4 PROPERTY OWNERS MULTI-PURPOSE IMPROVEMENT DISTRICT NO. 5 2026-001; TO ESTABLISH THE BOUNDARIES THEREOF; TO APPOINT 6 COMMISSIONERS; AND FOR OTHER PURPOSES. 7 8 WHEREAS, property owners who claim to be all of the owners of record title of real property 9 located within a proposed municipal property improvement district as described in Exhibit A have filed 10 a petition with the City seeking the formation of such district; and, 11 WHEREAS, pursuant to applicable Arkansas law, the City Clerk and Board of Directors of the 12 City of Little Rock, Arkansas, set a public hearing by Resolution to consider the creation of said 13 district; and, 14 WHEREAS, after due notice as required by law, a public hearing was held at 6:00 p.m. in the 15 Board Meeting Room on the second floor of City Hall, 500 West Markham,Little Rock,Arkansas,on 16 Tuesday, March 3, 2026, at which time all persons desiring to be heard were given the opportunity to 17 be heard;and, 18 WHEREAS, the Board of Directors finds that the petition was signed by persons claiming to be 19 all of the owners of record title of the real property located within the proposed district; that the 20 proposed district is in the best interest of the property owners therein and the City;and that all statutory 21 requirements for the creation of the district have been satisfied. .,11„;: i i t i t:r ORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 23 CITY OF LITTLE ROCK,ARKANSAS: 24 Section 1.Creation of District.There is hereby created a municipal property owners improvement 25 district to be known as Chenal Valley Municipal Property Owners Multi-Purpose Improvement District 26 No. 2026-001 (the "District"). 27 Section 2. Boundaries. The boundaries of the District shall be as set forth in Exhibit A attached 28 hereto and incorporated herein by reference. 29 Section 3. Purpose. The District is created for the purpose of financing, acquiring, constructing, 30 equipping, operating, and maintaining the improvements generally described in Exhibit B attached 31 hereto and incorporated herein by reference, together with all necessary, incidental, and related 32 improvements as authorized by law. [Page 1 of 61 1 Section 4. Commissioners. The following persons, being qualified electors of the State of 2 Arkansas and owners of property within the District, are hereby appointed as the initial Board of 3 Commissioners of the District,to serve until their successors are elected and qualified as provided by 4 law: 5 1. Greg Stewart 8 The Commissioners shall take the oath of office required by law and shall organize and operate the 9 District in accordance with applicable Arkansas statutes. 10 Section 5. Powers. The District shall have all powers granted to municipal property owners' II improvement districts under the laws of the State of Arkansas, including but not limited to the power 12 to assess benefits, levy assessments, issue bonds, and enter into contracts necessary to accomplish the 13 purposes of the District. 14 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 15 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or 16 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and 17 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 18 resolution. 19 Section 7. Code Ann. Title 14, Chapter 94 and 15 amendments thereto; and(vii)conducting any and all other acts which shall 16 be deemed necessary in order to purchase, construct, accept as a gift, 17 operate and maintain any and all improvements authorized therein 18 (together, the "Project"). Said purposes are to be accomplished in the 19 manner and with the materials that the commissioners for the District shall 20 deem to be in the best interest of the District and as specified by law.
