3 AN ORDINANCE TO CREATE THE CHENAL VALLEY MUNICIPAL
4 PROPERTY OWNERS MULTI-PURPOSE IMPROVEMENT DISTRICT NO.
5 2026-001; TO ESTABLISH THE BOUNDARIES THEREOF; TO APPOINT
6 COMMISSIONERS; AND FOR OTHER PURPOSES.

8 WHEREAS, property owners who claim to be all of the owners of record title of real property
9 located within a proposed municipal property improvement district as described in Exhibit A have filed
10 a petition with the City seeking the formation of such district; and,
11 WHEREAS, pursuant to applicable Arkansas law, the City Clerk and Board of Directors of the
12 City of Little Rock, Arkansas, set a public hearing by Resolution to consider the creation of said
13 district; and,
14 WHEREAS, after due notice as required by law, a public hearing was held at 6:00 p.m. in the
15 Board Meeting Room on the second floor of City Hall, 500 West Markham,Little Rock,Arkansas,on
16 Tuesday, March 3, 2026, at which time all persons desiring to be heard were given the opportunity to
17 be heard;and,
18 WHEREAS, the Board of Directors finds that the petition was signed by persons claiming to be
19 all of the owners of record title of the real property located within the proposed district; that the
20 proposed district is in the best interest of the property owners therein and the City;and that all statutory
21 requirements for the creation of the district have been satisfied.

23 CITY OF LITTLE ROCK,ARKANSAS:
24 Section 1.Creation of District.There is hereby created a municipal property owners improvement
25 district to be known as Chenal Valley Municipal Property Owners Multi-Purpose Improvement District
26 No. 2026-001 (the "District").
27 Section 2. Boundaries. The boundaries of the District shall be as set forth in Exhibit A attached
28 hereto and incorporated herein by reference.
29 Section 3. Purpose. The District is created for the purpose of financing, acquiring, constructing,
30 equipping, operating, and maintaining the improvements generally described in Exhibit B attached
31 hereto and incorporated herein by reference, together with all necessary, incidental, and related
32 improvements as authorized by law.

1 Section 4. Commissioners. The following persons, being qualified electors of the State of
2 Arkansas and owners of property within the District, are hereby appointed as the initial Board of
3 Commissioners of the District,to serve until their successors are elected and qualified as provided by
4 law:

6 2. Thomas Russell
7 3. Greg Stewart
8 The Commissioners shall take the oath of office required by law and shall organize and operate the
9 District in accordance with applicable Arkansas statutes.
10 Section 5. Powers. The District shall have all powers granted to municipal property owners'
II improvement districts under the laws of the State of Arkansas, including but not limited to the power
12 to assess benefits, levy assessments, issue bonds, and enter into contracts necessary to accomplish the
13 purposes of the District.
14 Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
15 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
16 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
17 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
18 resolution.
19 Section 7. Repealer.All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
20 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.

3 Description of Improvements

5 The improvements to be undertaken by the proposed district are generally
6 as follows: (i)constructing new,and improvements to,existing public streets
7 and roadways together with sidewalks and pedestrian paths appurtenant
8 thereto, storm drains and street lights for the new southern extension of
9 Chenonceau Boulevard,and such other street and road improvements and
10 secondary access drives incidental thereto as depicted in the map attached
11 as Exhibit B; together with modification to Chenal Parkway to allow for
12 construction of the fourth leg of the intersection of Chenal Parkway and
13 Chenonceau Boulevard, and to open, grade, drain, pave, curb, gutter or
14 otherwise improve such other streets,roads,highways,and every other way
15 for passage and use of vehicles, and including sidewalks, pedestrian trails
16 and walkways, viaducts, underpasses and appurtenant lighting, including
17 but not limited to modification of existing traffic signals and construction of
18 additional traffic signals at the intersection of Chenal Parkway and
19 Chenonceau Boulevard, either within or without the boundaries of the
20 District if the Property of the District will be benefited thereby, and such
21 purpose shall include the acquisition of rights of way by purchase or the
22 exercise of the power of eminent domain, and to maintain such streets,
23 roads, highways, and every other way for passage and use by vehicles and
24 pedestrians, lying within the boundaries of the District or beyond the
25 boundaries of the District if the Property of the District will be benefited
26 thereby; (ii) constructing new and modifying existing water mains along
27 Chenal Parkway and additional water mains and appurtenances at other
28 locations within or without the District as depicted on the map attached as
29 Exhibit B and other appurtenant water improvements either within or
30 without the boundaries of the District if the Property of the District will be
31 benefited thereby; (iii) constructing sanitary sewer gravity mains and
32 appurtenances,including roadway bores and appurtenances,as depicted on
33 the map attached as Exhibit B and other appurtenant sewer improvements

1 either within or without the boundaries of the District if the Property of the
2 District will be benefited thereby; (iv) acquiring and constructing electric
3 junction boxes, electric conduits, underground power lines, street lighting,
4 electrical distribution conduits, roadway boxes, conductors, pull boxes,
5 switchgears and switchgear pads,and other electric utility improvements as
6 depicted on the map attached hereto as Exhibit B either within or without
7 the boundaries of the District if the property of the District will be benefited
8 thereby; (v) constructing stormwater detention facilities,drainage culverts,
9 headwalls, and storm drainage facilities as depicted on the map attached as
10 Exhibit B and other appurtenant stormwater facilities and improvements
11 either within or without the boundaries of the District if the Property of the
12 District will be benefitted thereby; (vi) payment of professional fees related
13 to the design and construction of work described herein, and all other
14 purposes authorized by Ark. Code Ann. Title 14, Chapter 94 and
15 amendments thereto; and(vii)conducting any and all other acts which shall
16 be deemed necessary in order to purchase, construct, accept as a gift,
17 operate and maintain any and all improvements authorized therein
18 (together, the "Project"). Said purposes are to be accomplished in the
19 manner and with the materials that the commissioners for the District shall
20 deem to be in the best interest of the District and as specified by law. The
21 cost of the Project shall be assessed upon the real property of the District
22 according to the benefits received.
