Here are some brief comments: The report does not indicate whether this is a contributing structure. A 2. In the third paragraph, please eliminate the first sentence "This application is the result of an enforcement action." since the City has not taken any enforcement action yet. 3. 1 would also change the sentence after that to read that "The owner has submitted this application to amend ,/their COA in response to a letter from the City Attorney's Office dated March 6, 2006." (In case it is not the applicant's wish to amend their COA.) 4. To avoid confusion about jurisdiction, the discussion about the CUP should not be the basis for the HDC's decision. I would mention that "The presence of a detached accessory dwelling with kitchen and bath facilities will require approval by the Little Rock Planning Commission." and, set off in parenthesis, explain what the Planning Commission will consider and that any change in an approved amended COA will come back to the HDC. 5. Under "Previous Actions on This Site," The July 7, 2004 discussion is described as a public hearing, while the February 12, 2004 meeting is not. Please confirm, but I am thinking that the February 12 meeting was the advertised public hearing and that notices were not sent out for a July 7 hearing. The purpose of the July 7 discussion was only to approve materials -- as a condition of the already approved COA. This point should also be made in the point -by -point analysis under Number 3 and Number 4. 6. Also to avoid confusion about jurisdiction of the HDC and Planning Commission or Board of Adjustment, please make sure that your staff recommendations are based on the HDC guidelines and not on the zoning regulations. Any recommendation that exceeds the zoning limits could be made subject to approval by the PC or Bd.Adj.
