February 27, 2006 Bill Rettig and Karen Butler Miller 1301 Cumberland Little Rock, Arkansas 72206 Dear Mr. Retting and Ms. Miller, Our records indicate that the following modifications to the approved COA at 1301 were executed without approval of the Historic District Commission. These changes include: 1. Footprint Relocation of the outbuilding (increased setback). 2. The approved driveway was relocated. 3. A second story shed roof was added to the west fagade of the accessory structure. 4. Ceiling fans were installed on the underside of the second story shed roof. 5. Outdoor security lighting was installed on the north and south facades of the original structure. 6. The cinder block wall was constructed higher than specified and not built to the specifications indicated in the COA application. 7. A porch and stairway was added on the north side of the structure between the north facade of the accessory building and the wall. 8. Proposed ivy screening has not been planted to cover the cinder block wall. 9. Iron fencing was deleted from the cinderblock wall on the north side. This porch was not permitted and will require a variance approved by the Board of Adjustment. Please accept this letter as formal notice that construction activity at 1301 Cumberland Street was also carried out in violation of state law requiring that at Certificate of Appropriateness ("COX) be obtained prior to making alterations to a structure located in a local ordinance historic district. Our records indicate that the above listed items were installed in violation of this COA requirement. To bring your property into compliance with state law, you must either remedy the situation to comply with the approved COA or obtain a COA from the Little Rock Historic District Commission through the public hearing process. Please attend the March 13, 2006 meeting of the Historic District Commission to explain why the modifications to the COA were made. The meeting is at 5:00 pm in City Hall, 500 West Broadway. Failure to either remedy the situation to comply with the approved COA or obtaining a COA for the modifications will result in referral of this mater to the Prosecution Division of the Office of the City Attorney for enforcement proceedings.
