•• AN ORDINANCE TO APPROVE THE ABANDONMENT OF A PORTION
4 OF THE E. 26TH STREET RIGHT-OF-WAY LOCATED IMMEDIATELY
5 EAST OF MCALMONT STREET (G-23-497); TO PROVIDE FOR THE
6 RETENTION OF A UTILITY EASEMENT; AND FOR OTHER
7 PURPOSES.

9 WHEREAS,the owner of property adjacent to East 26th Street has submitted an application requesting
10 the abandonment of a portion of the East 26th Street public right-of-way located immediately east of
11 McAlmont Street,identified as Application No.G-23-497;and
12 WHEREAS,the portion of right-of-way proposed for abandonment is approximately sixty(60)feet in
13 width by two hundred eighty-five(285)feet in length,containing approximately 0.39 acres; and
14 WHEREAS, the subject right-of-way area is currently undeveloped and contains trees and
15 undergrowth; and
16 WHEREAS, the Little Rock Water Reclamation Authority must retrain a portion of the abandoned
17 right-of-way for future utility use;and
18 WHEREAS, Lenders Title Company has confirmed that there are no reversionary rights associated
19 with the portion of E. 26th Street proposed for abandonment;and
20 WHEREAS, all owners of property adjacent to the right-of-way and all neighborhood associations
21 registered with the City of Little Rock were notified of the public hearing in accordance with applicable
22 requirements;and
23 WHEREAS,the Planning Commission,at its meeting on November 13,2025,voted 7 ayes,0 noes,3
24 absent,and 1 open position, as part of the Consent Agenda, to recommend approval of the right-of-way
25 abandonment,and there were no objectors present; and
26 NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
27 OF LITTLE ROCK,ARKANSAS:
28 Section 1.The City Council hereby approves the abandonment of a portion of the E. 26th Street public
29 right-of-way located immediately east of McAlmont Street,more particularly described as follows:
30 Part of the Northwest Quarter of the Northeast Quarter(NW%NE' ),section 14,
31 Township 1 North, Range 12 West, in the City of Little Rock, Pulaski County,
32 Arkansas,more particularly described as follows:

1 Commencing at the Intersection of the West Line of Barber Street and the North
2 Line of 26th Street.Which is a street shown on the plat of the Watkins Addition to
3 the City of Little Rock,said plat being recorded in Mortgage Record Book AV-1,
4 Page 84; thence N87°13'34"W, along the North Line of said 26th Street, for a
5 distance of 284.84 feet to a found %" rebar for the point of beginning; thence
6 continuing N87°13'34"W, along the North Line of said 26th Street, for a distance
7 of 285.16 feet to a set of rebar with cap$1573 located at the Northwest Corner
8 of the Northeast Quarter(NE%)of said section 14;thence S2°59'15"W,leaving the
9 North Line of said 26th Street,for a distance of 285.00 feet to a set of%"rebar with
10 cap #1573; thence N3°08'32"E, leaving the South Line of said 26th Street, for a
11 distance of 60.00 feet to the point of beginning,containing 0.39 acres(17,105 S.F.),
12 more or less.(See Exhibits A& B).
13 Section 2. The abandonment approved herein is expressly subject to the retention, and/or dedication,
14 or both of any necessary utility easements, including but not limited to an easement in favor of the Little
15 Rock Water Reclamation Authority,as required for the operation, maintenance,repair,and replacement of
16 existing or future utility facilities.
17 Section 3.Upon abandonment,the subject right-of-way shall be incorporated into the adjacent property,
18 subject to all retained easements and applicable laws, regulations, and development requirements of the
19 City of Little Rock.
20 Section 4. The Mayor and City Clerk are hereby authorized and directed to take all actions necessary
21 to effectuate this abandonment, including execution and recording of any documents required to carry out
22 the intent of this ordinance.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
26 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
27 resolution.
28 Section 4. Repealer. All laws, ordinances,resolutions,or parts of the same,that are inconsistent with
29 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
