3 AN ORDINANCE TO PROVIDE CITY APPROVAL OF A PREVIOUSLY
4 PRE-APPROVED URBAN USE ("U-U") DISTRICT ZONING
5 JURISDICTION FOR A PRIVATE CLUB DESIGNATION FOR KERRY
6 LOU'S, LLC DB/A DREAMLAND LOUNGE, LOCATED AT 800 WEST
7 NINTH STREET, LITTLE ROCK, ARKANSAS; AUTHORIZING THE
8 APPLICANT TO PROCEED WITH THE STATUTORY APPLICATION
9 PROCESS BEFORE THE ARKANSAS ALCOHOLIC BEVERAGE
10 CONTROL DIVISION PURSUANT TO ARK. CODE ANN. § 3-9-222(a)(1)
11 AND ACT 1112 OF 2017; TO DECLARE AN EMERGENCY; AND FOR
12 OTHER PURPOSES.

14 WHEREAS, Kerry Lou's, LLC, doing business as Dreamland Lounge("Applicant"), is a private
15 establishment located at 800 West Ninth Street, Little Rock,Arkansas 72201; and,
16 WHEREAS, the subject property is located within an Urban Use ("U-U") District zoning
17 jurisdiction that has been previously pre-approved by the City of Little Rock for consideration of private
18 club uses, subject to compliance with applicable state law; and,
19 WHEREAS, Ark. Code Ann. § 3-9-222(a)(1), as amended by Act 1112 of 2017, requires an
20 applicant seeking a Private Club permit to serve alcoholic beverages in a dry or otherwise restricted area to
21 obtain approval from the local governing body confirming that the location is within a qualifying zoning
22 district and that the City does not object to the filing of such application with the Arkansas Alcoholic
23 Beverage Control Division of the Arkansas Department of Finance and Administration; and,
24 WHEREAS, the Applicant seeks City approval solely for the purpose of satisfying the statutory
25 prerequisite necessary to submit a Private Club permit application to the Arkansas Alcoholic Beverage
26 Control Division's Rules and Regulations and Arkansas Statutes;and,
27 WHEREAS,the City Council finds that the subject property is located within a qualifying zoning
28 district and meets the zoning and statutory prerequisites required under state law to allow the Applicant to
29 proceed with the state permitting process.
30 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
31 CITY OF LITTLE ROCK,ARKANSAS:

1 Section 1. The City Council hereby approves the previously pre-approved Urban Use District
2 zoning jurisdiction for the purpose of allowing Kerry Lou's, LLC d/b/a Dreamland Lounge, located at 800
3 West Ninth Street, Little Rock,Arkansas,to seek designation as a Private Club pursuant to Ark.Code Ann.
4 § 3-9-222(ax 1)and Act 1112 of 2017.
5 Section 2. This ordinance authorizes the Applicant to proceed with filing a Private Club permit
6 application with the Arkansas Alcoholic Beverage Control Division of the Arkansas Department of Finance
7 and Administration,as required by state law.
8 Section 3.Approval of this ordinance does not grant a Private Club permit, does not authorize the
9 sale or service of alcoholic beverages, including wine,and does not waive compliance with any applicable
10 federal, state,or local laws,regulations, or ordinances. Final approval, regulation, and enforcement of any
11 Private Club permit remain within the exclusive authority of the Arkansas Alcoholic Beverage Control
12 Division.
13 Section 4. Compliance with State Law. Passage of this ordinance affirms the City's compliance
14 with Ark. Code Ann. § 3-9-222(a)(I) and Act 1112 of 2017 and acknowledges that the proposed location
15 meets the zoning and statutory prerequisites necessary to proceed through the state's established permitting
16 process.
17 Section 3.Severability. In the event any title,section,paragraph, item,sentence,clause, phrase,or
18 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
19 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
20 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
21 ordinance.
22 Section 4.Repealer.All resolutions, bylaws,and other matters inconsistent with this ordinance are
23 hereby repealed to the extent of such inconsistency.
24 Section 5. Emergency Clause.The necessity of appropriate procedures to follow in order to obtain
25 a permit for the sale of alcoholic beverages that complies with state statutes and regulations, and which is
26 stated in a way acceptable to the ABC, is essential to the public health, safety and welfare, because it
27 provides a means for the ABC to undertake its appropriate enforcement, administrative, permitting duties;
28 an emergency is therefore dedicated to exist, and this ordinance shall be in full force and effect the date of
29 its passage.
