3 AN ORDINANCE TO APPROVE THE ACTION OF UPPER CRUST,
4 EVENT CENTER LOCATED AT 320 W. 7TH STREET, LITTLE ROCK,
5 ARKANSAS, (Z-10152) IN FILING AN APPLICATION FOR OPERATION
6 AS A PRIVATE CLUB PERMITTED AS DEFINED FROM THE
7 ARKANSAS ALCOHOL BEVERAGE CONTROL DIVISION OF THE
8 ARKANSAS DEPARTMENT OF FINANCE AND ADMINISTRATION; TO
9 COMPLY WITH ARK. CODE ANN. § 3-9-222(a)(1); TO DECLARE AN
10 EMERGENCY; AND FOR OTHER PURPOSES.

12 WHEREAS,on May 8, 2025, a Conditional Use Permit for an Event Center on 320 W. 7th Street
13 was approved by the Planning Commission to operate under the conditions of the Staff Report; and,
14 WHEREAS, Upper Crust Event Center, located at 320 W. 7th Street, Little Rock, Arkansas,
15 72201, (see Master Street Plan herein as Exhibit A) seeks to obtain a permit to operate as a private
16 club as defined by and in compliance with the Arkansas Beverage Control Division ("ABC") Rules
17 and Regulations and Arkansas Statutes; and,
18 WHEREAS, such a use for this property is within the exclusive jurisdiction of the City of
19 Little Rock and previously approved for such use through a UU, Urban Use District, zoning
20 designation; and,
21 WHEREAS, Act 1112 of 2017, codified at Ark. Code Ann. § 3-9-222(a)(I), as may be
22 amended, requires applicants for a Private Club License, as defined by the Arkansas Alcohol Beverage
23 Control Division, obtain approval of the governing body of the City or County where the private club
24 is to be located to follow the statutory process.
25 NOW,THEREORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
26 OF LITTLE ROCK,ARKANSAS.
27 Section 1. Pursuant to Act I 112 of 2017 as amended, the City of Little Rock, Arkansas,
28 approves the action of Upper Crust Event Center,to follow the statutory process to file a Private Club
29 Application with the Department of Finance and Administration, Alcoholic Beverage Control
30 Division, for the location at 320 W. 7th Street, Little Rock,Arkansas, 72201.
31 Section 2. A copy of this ordinance may be provided to the ABC Division of the Arkansas
32 Department of Finance and Administration as evidence that the City Governing Body has authorized
33 such a use within this zoning classification.

1 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
2 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
3 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
4 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
5 originally a part of the ordinance.
6 Section 4.Repealer.All resolutions,bylaws,and other matters inconsistent with this ordinance
7 are hereby repealed to the extent of such inconsistency.
8 Section 5. Emergency Clause. The necessity of appropriate procedures to follow in order to
9 obtain a permit for the sale of alcoholic beverages that complies with state statutes and regulations,
10 and which is stated in a way acceptable to the ABC is essential to the public health, safety and welfare,
11 because it provides a means for the ABC to undertake its appropriate enforcement. administrative,
12 permitting duties: this ordinance cannot proceed until such language is in place; therefore, an
13 emergency declared to exist, and this ordinance shall be in full force and effect from and after the date
14 of its passage.
