The tax assessor of Pulaski County shows you as the owner of lot LTS 9-10-11 & 12
EXC 41 SQ FT MOL FOR R/W , block of the Original City of Little Rock known
as 902 CUMBERLAND ST. This property is within the MacArthur Park Local Ordinance
Historic District and is subject to all rules and regulations of that district.
Please accept this letter as formal notice that construction activity at Street was
also carried out in violation of state law requiring that a Certificate of Appropriateness
("COX) be obtained prior to making alterations to a structure located in a local
ordinance historic district. Our records indicate that new windows, doors and siding
were installed without a current building permit and were installed in violation of
this COA requirement. You received a stop work order to cease all construction activity
at Street until your building permit is renewed. To bring your property into
compliance with state law, you must either restore the original materials to the structure
or obtain a COA from the Little Rock Historic District Commission by filing an application
and fulfilling all requirements thereof. One is attached for your convenience.
Failure to obtain a COA and a building permit (if applicable) for the new roof will result in
referral of this matter to the Zoning Enforcement Division of the City of Little Rock
Planning and Development Department for enforcement proceedings in the City of Little
Rock Municipal Court.

Description: This rule change would increase the maximum height of allowable front yard fences from 40 inches
to 48 inches, and on backyard fences from six feet to eight feet. These changes would affect historic properties
throughout the Capitol Zoning District, and all properties in Zones M & N.
Previous Action: Staff has issued numerous permits for 40 inch front yard fences and six foot backyard fences
over the last three years. Since 2011, the Commission has approved one request for a 48 inch fence on a non -
historic property, and denied a similar application at a historic property. The Commission has approved several
eight -foot tall backyard fences, when the top two feet are comprised of semi -transparent wood lattice.
Neighborhood Reaction: Staff has received extensive citizen communication regarding the agency's rules on
fence heights.
Staff Recommendation: Staff recommends the Commission initiate the rulemaking process and release the
proposed changes for public comment.
