BILL OF ASSURANCE
WHEREAS, SYDNEY HUNSICKER AND JACK LLOYD, wife and husband
(collectively, "Grantors"), are the owners of the following described land lying in the City of Little
Rock, Pulaski County, Arkansas, and more fully described in Exhibit 1, attached hereto and
incorporated herein (the "Land").
Grantors have caused the Land to be surveyed and a plat (the "Plat") thereof made, which
is identified by the title of "Lot 1 and Lot 2, Hunsicker Division, being a replat of all of Lot 11 and
the South One -Half of Lot 12, Block 18, Lincoln Park Addition, an addition to the City of Little
Rock, Pulaski County, Arkansas". This Bill of Assurance (the 'Bill of Assurance") and the Plat
have been signed by said Grantors, and the Plat is to be recorded as Instrument No.
in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County,
Arkansas, contemporaneously with this Bill of Assurance. Grantors do hereby make this Bill of
Assurance to govern and control the land described in the Plat. The Plat replaces any previous plat
of the property thatt is the subject of the Plat.
HEREAFTER, conveyances and descriptions of the property as shown on the Plat shall be
a proper and sufficient description thereof.
Lot 1 and Lot 2, Hunsicker Division, being a replat of all of Lot 11 and the South One -Half
of Lot 12, Block 18, Lincoln Park Addition, an addition to the City of Little Rock, Pulaski County,
Arkansas (the "Property"), shall be conveyed by Grantors and shall be acquired by the grantees
thereof, subject to the covenants contained herein and the Plat.
RIGHTS OF WAY: With the filing of this Bill of Assurance and the Plat in the office of
the Circuit Clerk of Pulaski County, Arkansas, the rights -of -way
shown on the Plat, if any, are hereby dedicated to the City of Little
Rock. Any utility easements shown thereon are hereby dedicated to
the appropriate public utilities.
TERMlAN1ENDMENT: This Bill of Assurance shall be in full force and effect in perpetuity,
subject to the following amendment and termination rights of the
owners of the Property. This Bill of Assurance may be amended or
terminated at any time from the date hereof by the unanimous
written agreement of the owners of the Property. Grantors are
mindful of the decision in Rausch Coleman Homes, LLC v. Brech,
2009 Ark. App. 225 (the "Decision"), and do not wish for the
Decision to limit the ability of the parties to amend this Bill of
Assurance at any time and from time to time. Grantors intend that
this Bill of Assurance may be amended at any time from the date
hereof throughout the term of this Bill of Assurance and expressly
intend and agree that this Bill of Assurance may be amended prior
to any expiration or termination date set forth herein, all as provided
in Arkansas Code Annotated § 18-12-103.
RESTRICTIONS: Grantors and all future grantees of the property described in this Bill
of Assurance and the Plat specifically agree that all ordinances of
the City of Little Rock shall be strictly adhered to and followed, and
should the Plat or this Bill of Assurance be contrary in any way to
the ordinances adopted by the City of Little Rock from time to time,
such ordinances shall have precedence.
All buildings constructed on the Property shall be constructed no
nearer the street than any building line shown on the Plat, and all
buildings shall be constructed in conformance with the Building
Code and Zoning Ordinance of the City of Little Rock, Arkansas.
The Property shall be held, conveyed, and transferred only as a
single tract and shall not be sold, conveyed, or otherwise transferred
separately, it being the intent of this restriction to prohibit the
separate sale, conveyance, or transfer of Lot 1 apart from Lot 2, or
Lot 2 apart from Lot 1; provided, however, that this restriction shall
not prohibit (i) the conveyance of both Lot 1 and Lot 2 together in
the same instrument or (ii) the granting of a mortgage, deed of trust,
or other lien affecting Lot 1, Lot 2, or both.
All buildings and improvements constructed on the Property shall
be constructed and maintained in accordance with, and subject to,
the covenants, conditions, and restrictions set forth in that certain
Bill of Assurance for the Lincoln Park Addition to Pulaski Heights,
Arkansas, executed by Mercantile Trust Company, as declarant,
dated July 1, 1907, and recorded in Volume 1, Page 63 in the office
of the Circuit Clerk and Ex-Officio Recorder of Pulaski County,
Arkansas, and no building or improvement shall be erected, altered,
or used upon said Property except in compliance therewith.
