Staff Analysis: The C-3 zoned property located at 3519 Old Cantrell Road is occupied by a restaurant which is located along the eastern portion of the lot with parking areas along the west and south sides of the property . The applicant is proposing to locate a new 78 square foot metal sign upon the south roof area of the building to increase visibility of the business from Cantrell Road to the southwest. The applicant states the sign will be approximately 43-inches in height and 271- inches in length with 9-inch anchoring brackets extending to the roof structure of the rear portion of the building. DECEMBER 18, 2025 Z-10223 ITEM NO.: 1 Section 36-543 of the City's Zoning Ordinance prohibits Roof Signs, or any sign that is not mounted on a vertical surface. Therefore, the applicant is requesting a variance to allow the proposed roof mounted sign on the south building roof area, which has street frontage along Cantrell Road. Staff is supportive of the requested variance and views the request as reasonable. The proposed roof mounted sign on the south building roof area will be visible by northbound traffic on Cantrall Road located along the southwest perimeter of the property. Staff believes the proposed signs are proportionally small in nature and should have no adverse impact on the adjacent properties. E. Staff Recommendation: Staff recommends approval of the requested variance to allow a roof mounted sign with minimal street frontage, subject to the descriptions and any conditions contained in the "staff analysis". Board of Adjustment (December 18, 2025) The applicant was present. There were no objectors present. Staff presented the application to the Board and stated it recommended approval as per the staff report. The item remained on the consent agenda for approval. There was a consent motion to approve the application. The motion was seconded. The application was approved on consent. The vote was 4 ayes, 0 nays and 1 absent. The motion passed. Staff Analysis: The property located at 14 Windrush Paint is occupied by a 3,518 square foot two story single-family residence. The survey shows a lot width of 95.17 feet and depth of 115 feet. 1 DECEMBER 18, 2025 ITEM NO. 2 Z-1 D224 The site plan indicates that the existing 6.8 square foot deck extends northwest from the residence occupying the center of the yard at the rear of the dwelling. The applicant proposes to construct a 16.8 square foot wood frame deck screened enclosure. The applicant states the new deck structure will extend an additional 10 feet into the rear yard area. Section 36-254(d)(3) states "There shall be a rear yard setback having a depth of not less than twenty-five (25) feet. "Therefore, the applicant is requesting a variance to allow the extension of the primary structure into the rear yard area reducing the setback to no less than 8-feet. Staff is supportive of the requested variance. Staff views the requests as reasonable. The reduction of rear yard area for the screened in deck structure is similar to development patterns in the area. Staff believes that the requested variance will have no adverse impact on the surrounding properties. E. Staff Recommendation: Staff recommends approval of the requested rear yard setback reduction from twenty-five (25) feet to a minimum of 8 feet only at the portion of the property that references the deck addition, with the following conditions: 1.
