Dear Ms. Rosalind "Michelle" Welch,
Your item for the "Addition to rear of house, roof replacement, siding replacement, picket fence
in front with arbor and exterior lighting" was deferred to the August 18, 2008 meeting of the
commission. That meeting was moved from the August 11 to the August 18. Please note the
new date. The time and location have not changed.
You item was deferred for the first time. According to the bylaws of the Commission, Article V
Section E # 8 Deferrals: "In no case shall more than two requests for deferral from an
application be granted." It is important that you complete your notices of the surrounding
property owners in a timely fashion and attend the meeting on August 18.
The bylaws also state in Article V Section E # 6: Reconsideration. "No application for a
Certificate of Appropriateness for property shall be considered if a former application embracing
the same property or a portion thereof has been denied by the Commission within a period of 12
months preceding the application, except for cause and with unanimous consent of all members
present at a regular meeting. If the Commission decides to rehear a case it will require legal ad,
notice to owners, etc., as required for new application." If your item is not heard on August 18,
2008, you will be prohibited from filing the same application before the Commission for 12
months. That will delay the installation of the windows and fence for one year.
Your notices must be mailed to the property owners 10 days before the meeting (August 7,
2008) and you must provide the letter from the abstractor, the notice form, and the certified mail
receipts to this office no later than August 11, 2008. You must provide hand stamped receipts
from the post office to show that the individual letters were mailed certified and return receipt
requested.
If there are any questions, please call me.
Sincerely,
Brian Minyard
