HomeMy WebLinkAboutHDC1995-007 Ehereas, The City Of Little Rock Board Of Directiors Ordinance No. 17-1491 2 k, 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ORDINANCE No. i7,149 AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO ACQUIRE THE HISTORIC TATE HOUSE AT 615 EAST CAPITOL AVENUE, WHEN THE BOARD OF DIRECTORS APPROPRIATES FUNDS NECESSARY TO PAY JUST COMPENSATION, AND DECLARING AN EMERGENCY. WHEREAS, the City of Little Rock Board of Directors (the ".Boards) recognizes that the historic Tate House at 615 East Capitol Avenue, which lies within MacArthur Park Historic District, represents an architectural product of distinct period in the history of the City; and WHEREAS, the Tate House is an example of a unique historic structure which should be preserved, but which has fallen into disrepair and in need of immediate rehabilitation; and WHEREAS, the Board finds that in the case -of the Tate House, it is an appropriate public purpose that the City save the structure by instituting eminent domain proceedings to acquire title to the property and pay just compensation to the owners; and WHEREAS, once the Board appropriates the funds necessary for the City Attorney to commence condemnation proceedings, and when possession of the Tate House is obtained, City staff shall take steps necessary to secure the Tate House and to keep it secured, taking whatever steps are necessary to accomplish same. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 'l. The City Attorney is authorized to institute condemnation proceedings to acquire the Tate House property for the lawful purpose of historic preservation of the structure, and to acquire immediate possession to secure and maintain_ the premises. SECTION 2.
