3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AMEND LITTLE ROCK, ARK. ORDINANCE 22,019
5 (AUGUST 3, 2021); TO AUTHORIZE THE CITY MANAGER TO AMEND
6 THE AGREEMENT WITH THE CENTRAL ARKANSAS LIBRARY
7 SYSTEM IN AN AMOUNT NOT TO EXCEED ONE HUNDRED
8 THOUSAND DOLLARS ($100,000.00) TO PROVIDE PROGRAMMING
9 COORDINATION, MEETINGS AND APPLICATIONS FOR THE BE
10 MIGHTY SUMMER MEALS PROGRAM; TO DECLARE AN
11 EMERGENCY;AND FOR OTHER PURPOSES.

13 WHEREAS, in 2019, the Be Mighty Summer Meals Program was established to reduce hunger
14 in the Little Rock community and to expand participation in such a program was funded by the National
15 League of Cities to be carried out by the Central Arkansas Library System("CALS"); and,
16 WHEREAS, it was determined to continue this program in 2020 with funds provided by the City
17 of Little Rock, Arkansas and to once again use CALS for the programming, coordination, meeting and
18 application(s)for such programs; and,
19 WHEREAS, the data that CALS gathered, the efforts it has made and intends to make to extend
20 the participation in this program, and the steps it is already prepared to take to extend this program further
21 so that more locations and more people will participate in this program; and,
22 WHEREAS, the loss of data compilation options in addition to the experience(s)that CALS has
23 gathered makes it impractical and unfeasible to subject this program to a competitive selection and bid
24 process; and,
25 WHEREAS,the program has continued to be successful and beneficial through the first contract
26 extension in 2022; and,
27 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
28 CITY OF LITTLE ROCK,ARKANSAS:
29 Section 1. The Board of Directors of the City of Little Rock declares that it is impractical and
30 unfeasible to subject the Be Mighty Summer Meal Program for 2026 to a competitive selection and bid
31 process since to do so could cause loss of data compilations and the valued experience gained by the Central
32 Arkansas Library System since 2019.
33 Section 2. The City Manager is authorized to enter into an extension agreement with

1 Central Arkansas Library System from January 1, 2026, through December 31, 2026, in an
2 amount not to exceed One Hundred Thousand Dollars ($100,000.00) to provide coordination of
3 programming, meetings and applications of the Be Mighty Summer Meal Program.
4 Section 3. Funds for this extension agreement are available in the 2026 Budget allocation for
5 the Community Programs Department. Activity Codes for funding will be assigned after completion
6 of the contract process.
7 Section 4. Absent changes in circumstances, law or legislation which would make it practical
8 and unfeasible to submit this extension agreement to a competitive selection and bid process, the City
9 Manager hereby as the authority to grant a contract extension for 2026.
10 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
11 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
12 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
13 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
14 resolution.
15 Section 6. Repealer.All laws, ordinances, resolutions, or parts of the same, that are inconsistent
16 with the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
17 Section 7. Emergency Clause. The necessity to operate competent and effective feeding programs
18 is essential to the public health, safety and welfare to reduce hunger with the City of Little Rock; an
19 emergency, therefore, is declared to exist and this ordinance shall be in full force and effect from and after
20 the date of its passage.
