3 AN ORDINANCE AMENDING LITTLE ROCK, ARKANSAS,
4 ORDINANCE NO. 21,944 (MAY 18, 2021); AUTHORIZING THE CITY
5 MANAGER TO CONTINUE THE EXISTING AGREEMENT BETWEEN
6 THE CITY OF LITTLE ROCK AND GOVERNMENTJOBS.COM, INC.,
7 D/B/A NEOGOV (NEOGOV), FOR THE LEARN MODULE; IN AN
8 AMOUNT NOT TO EXCEED SEVENTY THOUSAND DOLLARS
9 ($70,000.00) FOR THE PERIOD OF NOVEMBER 1, 2025, THROUGH
10 OCTOBER 31,2026; AND FOR OTHER PURPOSES.

12 WHEREAS, the City of Little Rock has utilized NEOGOV human-resources software services since
13 2009;and
14 WHEREAS, over time, additional integrated services have been acquired by the City, including the
15 Applicant Tracking System (Insight/OHC, with analytics), testing modules, on-line testing platforms,
16 texting features,virtual interviewing services,background vendor integrations,an onboarding module,and
17 a learning management system module; and
18 WHEREAS, Little Rock, Arkansas, Ordinance No. 21,821 (December 17, 2019) approved upgrades
19 to the NEOGOV software services;and
20 WHEREAS, Little Rock,Arkansas,Ordinance No. 21,944 (May 18, 2021)authorized the addition of
21 the NEOGOV Learn Program in an amount not to exceed One Hundred Thirty-Five Thousand Dollars
22 ($135,000.00); and
23 WHEREAS,the City has since incorporated additional modules and integrations including Biddle(on-
24 line testing), Spark Hire (virtual interviewing), and Choice Screening (background vendor) which have
25 resulted in increased annual costs;and
26 WHEREAS, the additional costs for the continued use of the NEOGOV Learn learning management
27 system module will exceed the previously authorized funding amount under Ordinance No. 21,944; and
28 WHEREAS, the City desires to continue the agreement with NEOGOV for the Learn module for the
29 period of November 1, 2025, through October 31, 2026, in an amount not to exceed Seventy Thousand
30 Dollars($70,000.00).
31 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
32 OF LITTLE ROCK,ARKANSAS:

1 Section 1.The City Manager is hereby authorized to continue the existing agreement between the
2 City of Little Rock and GovernmentJobs.com, Inc., d/b/a NEOGOV, for the continued use of the Learn
3 learning management system module for the period of November 1,2025,through October 31,2026.
4 Section 2. Ordinance No. 21,994 is hereby amended to authorize an expenditure not to exceed
5 Seventy Thousand Dollars($70,000.00)for continuation of the NEOGOV Learn module during the period
6 specified.
7 Section 3. Funding for this expenditure is available in the City's General Fund Budget, Account
8 No. 100000-14010.
9 Section 4.Severability.In the event any title, section,paragraph, item,sentence,clause,phrase,or
10 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
11 adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and
12 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
13 ordinance.
14 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
15 with the provisions of this ordinance,are hereby repealed to the extent of such inconsistency.
16 Section 6. Effective Date. This ordinance shall take effect 30 days after passage and publication
17 as required by law.

1 (1)A five-year capital improvement plan will be developed biannually and updated annually,including
2 anticipated funding sources. Capital improvement projects are defined as infrastructure or equipment
3 purchases or construction that results in a capitalized asset exceeding$10,000 and having a useful life
4 (depreciable life)of one(1) year or more.
5 (2) The capital improvement plan will include all major capital projects with a total proposed cost
6 valued at $50,000 or more. Capital improvements with a value less than $50,000 shall be included in
7 the annual operating budget process. These improvements are referred to as capital outlays. Repairs
8 are the maintenance of an existing capital asset to preserve or restore the asset to its original condition
9 are not eligible for inclusion in the capital improvement plan. The city will expense repairs to the
10 appropriate operating fund and department.
11 Section 4. Little Rock, Ark., Rev.Code § 2-260.4(5) is amended to read as follows:
12 (5) The city will strive to provide for a minimum of five (5) percent of internal, pay-as-you-go
13 financing for its capital improvement program. Funding may come from fund balance reserves or any
14 other acceptable means of funding.
15 Section 5. Little Rock,Ark., Rev. Code § 2-260.5 (4) is amended to read as follows:
16 (4) Financing shall not exceed the useful life of the asset being acquired or constructed.
17 Section 6. Little Rock,Ark., Rev. Code§ 2-260.5 (6) is amended to read as follows:
18 (6) The general policy of the city is to establish debt repayment schedules that use level annual
19 principal and interest payments. Any deviations from this must be communicated prior to the issuance
20 of the debt explaining the reason for the deviation.
21 Section 7. Little Rock, Ark., Rev. Code § 2-260.5 (9) is amended to read as follows:
22 (9) Utility or waste disposal rates will be set to ensure debt service coverage exceeds the bond indenture
23 requirement of one hundred twenty-five(125)percent.
24 Section 8. Little Rock,Ark., Rev.Code § 2-260.6(2)is amended to read as follows:
25 (2) The general fund goal is to set aside ten million dollars ($10,000,000.00) or ten (10) percent of
26 general fund revenues,whichever is greater, into a restricted reserve fund.
27 Section 9. Little Rock,Ark., Rev. Code § 2-260.6(4) is amended to read as follows:
28 (4) The waste disposal fund will maintain an unrestricted net position reserve of no less than fifteen
29 (15)percent of current year revenues.
30 Section 10. Little Rock,Ark., Rev.Code §2-260.6 is amended to add an additional subsection to read
31 as follows:
32 At the end of the fiscal year and upon completion of the related annual audit, the city will annually
33 transfer any general fund surplus to the restricted reserve fund to meet target reserve requirements for
34 future periods.
