3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH J.A. RIGGS, TO APPROVE THE
5 EXPENDITURE OF FUNDS IN AN AMOUNT NOT TO EXCEED ONE
6 HUNDRED THIRTY THOUSAND, ONE HUNDRED THIRTY-FOUR AND
7 71/100 DOLLARS ($130,134.71); FOR THE PURCHASE OF ONE (1)
8 CATERPILLAR MODEL 420-4AEM BACKHOE LOADER FOR THE
9 PUBLIC WORKS STREET DEPARTMENT; AND FOR OTHER
10 PURPOSES.

12 WHEREAS, the Public Works Street Department has identified the need to purchase one (1)
13 Caterpillar Model 420-4AEM Backhoe Loader to support ongoing street construction, maintenance, and
14 operational activities and to replace an older unit,02N 125,which has accrued excessive maintenance costs
15 and operational downtime,making continued use economically impractical; and,
16 WHEREAS,vendor selection for this purchase is available through Sourcewell Contract No. 020223-
17 CAT,which meets the City's procurement requirements;and,
18 WHEREAS,the total cost for the purchase of the equipment is One Hundred Thirty Thousand One
19 Hundred Thirty-Four and 71/100 Dollars ($130,134.71).
20 NOW,THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK,ARKANSAS:
22 Section 1. The City Manager is hereby authorized to enter into a contract with J. A. Riggs
23 for the purchase of one (1) Caterpillar Model 420-4AEM Backhoe Loader for the Public Works
24 Street Department in an amount not to exceed One Hundred Thirty Thousand One Hundred Thirty-
25 Four and 71/100 Dollars ($130,134.71).
26 Section 2. Funds for this purchase are allocated in the Public Works Special Project
27 Account No. 25409-72200-S40B677.
28 Section 3.Severability. In the event any title, paragraph, item,sentence,clause,phrase,or word of this
29 resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall
30 not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion
31 so declared or adjudged invalid or unconstitutional were not originally a part of the resolution.
32 Section 4.Repealer. All laws,ordinances,resolutions,or parts of the same,which are inconsistent with

1 the provisions of this resolution are hereby repealed to the extent of such inconsistency.
