3 AN ORDINANCE TO DECLARE IT IMPRACTICAL AND UNFEASIBLE
4 TO BID; TO AUTHORIZE THE CITY MANAGER TO ENTER INTO A
5 CONTRACT AMENDMENT WITH AT&T ENTERPRISES, LLC, IN AN
6 AMOUNT NOT TO EXCEED SEVEN HUNDRED THOUSAND DOLLARS
7 ($700,000.00), FOR AT&T HOSTED VESTA 911 SERVICE TELEPHONE
8 SYSTEM UTILIZED BY THE CITY' S EMERGENCY
9 COMMUNICATIONS DEPARTMENT AS AUTHORIZED BY THE
10 PASSAGE OF LITTLE ROCK ARK., RESOLUTION NO. 21,989 (MAY 4,
I 1 2021);AND FOR OTHER PURPOSES.

13 WHEREAS, the passing of Little Rock, Ark. Ordinance No. 21,989 ( May 4, 2021) authorized the
14 City's Emergency Communications Department to enter into a sole-source service agreement with
15 Southwestern Bell Telephone Company doing business as AT&T Enterprises, LLC, for the AT&T hosted
16 VESTA 911 service phone system also known as the Public Safety Answering Point Solution(PSAP);and
17 WHEREAS, AT&T Enterprises, LLC is the sole purveyor of the AT&T hosted VESTA 911 service
18 phone system utilized by the City's Emergency Communications Department since 2021; and,
19 it is unfeasible and impractical to ;and,
20 WHEREAS,it is unfeasible and impractical to put this service through the City's required competitive
21 bid process; and,
22 WHEREAS,the City's total cost to enter into a contract amendment to extend AT&T hosted VESTA
23 911 service phone system with AT&T Enterprises, LLC, is in the amount of Seven Hundred Thousand
24 Dollars($700,000.00), including applicable taxes and fees for a period of ten(10)years.
25 WHEREAS,Pulaski County has agreed to continue to pay AT&T for the City's monthly recurring cost
26 to maintain this service at an annual cost of One Hundred Fifty-Thousand Dollars($150,000.00); and,
27 WHEREAS, the City and Pulaski County wish to enter into an Interlocal Agreement regarding To
28 formalize the arrangement for Pulaski County to continue paying AT&T for the City's annual cost of One
29 Hundred Fifty-Thousand Dollars ($150,000.00), to maintain its AT&T hosted VESTA 911 service phone
30 system.
31 NOW,THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
32 OF LITTLE ROCK,ARKANSAS:

1 Section 1. Because AT&T Enterprises, LLC, is the sole purveyor of the VESTA 911 service system the
2 City uses,the Board of Directors declares it impractical and infeasible to bid.
3 Section 2.The Board of Directors hereby authorizes the City Manager to enter into a contract amendment
4 to continue AT&T hosted VESTA 911 service phone system with AT&T Enterprises,LLC, is in the amount
5 of Seven Hundred Thousand Dollars($700,000.00), including applicable taxes and fees for a period of ten
6 (10)years.
7 Section 3. Pursuant to the authority of Ark. Code Ann. § 25-20-101 et. seq., the Mayor is hereby
8 authorized to enter into an interlocal agreement and execute any all necessary documents, between the City
9 of Little Rock, Arkansas and Pulaski County for the purpose of formalizing the arrangement for Pulaski
10 County to continue paying AT&T for the City's annual cost of One Hundred Fifty-Thousand Dollars
11 ($150,000.00),to maintain its AT&T hosted VESTA 911 service phone system.
12 Section 4.Funds for this program are available from the 911 Wireless Fund Account No. 220512.
13 Section 5.Severability.In the event any title,section,paragraph,item,sentence,clause,phrase,or word
14 of this ordinance is declared or adjudged to be invalid or unconstitutional,such declaration or adjudication
15 shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the
16 portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance.
17 Section 6.Repealer.All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
18 the provisions of this resolution,are hereby repealed to the extent of such inconsistency.
19 Section 7. Emergency Clause. The need to maintain uninterrupted VESTA 911 service phone system
20 services is essential to ensure public welfare and safety; thus an emergency is, therefore, declared to exist
21 and this ordinance shall be in full force and effect from and after the date of its passage.
