3 A RESOLUTION TO FILL TWO (2) VACANCIES ON THE BOARD OF
4 COMMISSIONERS FOR THE YORKWOOD RECREATIONAL
5 IMPROVEMENT DISTRICT NO.3;AND FOR OTHER PURPOSES.

9 WHEREAS,the Yorkwood Recreational Improvement District No. 3 ("the District")was created
10 originally as a Pulaski County Improvement District;however,it is now located within the corporate limits
11 of the City of Little Rock,Arkansas("the City"), and legislative actions must be taken by the Little Rock
12 Board of Directors;and,
13 WHEREAS,by Little Rock,Ark., Ordinance No. 22,668 (October 6, 2025)the size of the Board
14 of Commissioners of the Improvement District was increased from three(3)to seven(7)members;and,
15 WHEREAS, the Little Rock Board of Directors shall make the four(4)additional appointments
16 within sixty(60)days of the effective date of Ordinance No.22,668(October 6,2025)to ensure continuity
17 of District operations and governance;and,
18 WHEREAS, the District currently operates with only two (2) commissioners following recent
19 resignations,creating potential governance challenges and limiting the District's ability to conduct official
20 business and achieve a proper quorum;and,
21 WHEREAS, there are vacancies on the Board of Commissioners of the Recreational Improvement
22 District,and it is now necessary to appoint two(2)commissioners to fill the vacant positions; and achieve
23 a proper quorum, additionally, further appointments will be presented to the City of Little Rock Board of
24 Directors for approval as applications are received;and,
25 WHEREAS, pursuant to Arkansas Code § 14-88-301(ax 1)(AXiv)(a), the city council shall appoint
26 owners of real property in the district as commissioners;and,
27 WHEREAS,by applications of real property owners in the Improvement District, it is recommended
28 that the City appoint Felicia N. Hodges and Wanda Townsend, property owners within the boundaries of
29 the Improvement District, who are qualified and willing to fill the vacancy and serve on the Board of
30 Commissioners.
31 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
32 OF LITTLE ROCK, ARKANSAS.

1 Section 1. The Board of Directors hereby appoints Felicia N. Hodges, and Wanda Townsend as
2 Commissioners on the Board of Commissioners of the Yorkwood Recreational Improvement District No.
3 3 of the City of Little Rock and shall perform the duties as set out in Arkansas Code §14-48-131.
4 Section 2. Term. The terms for Felicia N. Hodges and Wanda Townsend shall begin upon the
5 adoption of this Resolution and shall be for a period of the terms of office pursuant to Little Rock, Ark.,
6 Ordinance No. 22,668 (October 6, 2025) for the four (4) additional commissioners shall be staggered as
7 follows:
8 a)Two(2)commissioners shall serve initial terms of three(3)years;
9 b)Two(2)commissioners shall serve initial terms of six(6)years;
10 c)All subsequent terms shall be six(6)years as provided by Arkansas law.
11 Section 3. Severability. The various parts, sections and clauses of this resolution are hereby declared
12 to be severable. If any part, sentence, paragraph, section or clause is adjudged unconstitutional or invalid
13 by court of competent jurisdiction,the remainder of this resolution shall not be affected thereby.
14 Section 4. Repealer. All laws,ordinances,resolutions,or parts thereof in conflict with the provisions
15 of this resolution are hereby repealed to the extent of such conflict.
16 Section 5. Emergency Clause. It appearing that the District currently operates with insufficient
17 commissioners to conduct regular business and that the expansion of the board is necessary for proper
18 governance and to address ongoing community concerns, an emergency is hereby declared to exist, and
19 this ordinance shall be in full force and effect from and after its passage and approval.
