3 A RESOLUTION TO AUTHORIZE THE MAYOR TO ACCEPT,
4 FOR MUNICIPAL PURPOSES, PERMANENT CONSTRUCTION
5 EASEMENTS, RIGHT-OF-WAY DEDICATIONS, AND FEE-
6 SIMPLE ACQUISITIONS; AND TO AUTHORIZE THE CITY
7 MANAGER TO ACQUIRE TEMPORARY CONSTRUCTION
8 EASEMENTS AS NEEDED TO COMPLETE THE
9 CONSTRUCTION OF THE BOWMAN ROAD PHASE 2 PROJECT;
10 AND FOR OTHER PURPOSES.

12 WHEREAS, on August 19, 2025, the City Board of Directors adopted Resolution No.
13 16,782 expressing the willingness of the City of Little Rock to utilize Federal-Aid Surface
14 Transportation Block Grant Funds for Bowman Road Improvements, Phase 2; and,
15 WHEREAS, on August 19, 2025, the City of Little Rock was notified by the Arkansas
16 State Highway Commission that it had been awarded $2,800,000 in Surface Transportation Grant
17 Funds for the right of way and utility phases of Job 061803, Bowman Road Improvements, Phase
18 2,to be matched by local funding of$700,000; and,
19 WHEREAS, the acquisition of Easements, Right of Ways, and Fee Simple Acquisitions
20 is needed to accomplish the future construction, maintenance, and continued public access to the
21 improvements of the road.
22 NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
23 THE CITY OF LITTLE ROCK,ARKANSAS:
24 Section 1. The City Manager is authorized to pursue the acquisition of Permanent
25 Construction Easements, Drainage Easements, Right-of-Way Dedications, Fee Simple
26 Acquisitions, and Temporary Construction Easements as needed to complete the Bowman Road
27 Phase 2 project.
28 Section 2. The Mayor is authorized to accept Permanent Construction Easements, Right-
29 of-Way Dedications, and Fee Simple Acquisitions for municipal purposes, and the City Manager
30 is authorized to accept Temporary Easements needed for construction.
31 Section 3. The City of Little Rock's share of funding for this project is from the 3/8-Cent
32 Capital Improvement Sales and Compensating Use Tax authorized by Resolution 13,343 (July 11,
33 2011)with funds from Account Activity TS40C34.

1 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
2 or word of this resolution is declared or adjudged to be invalid or unconstitutional,such declaration
3 or adjudication shall not affect the remaining portions of the resolution which shall remain in full
4 force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
5 originally a part of the resolution.
6 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same,that are inconsistent
7 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
