3 A RESOLUTION OF INTENT TO AUTHORIZE PAYMENT TO THE HOUSING
4 AUTHORITY OF THE CITY OF LITTLE ROCK FOR THE PURCHASE OF 65 ACRES
5 OF PROPERTY AND IMPROVEMENTS FOR THE AMOUNT OF FOUR HUNDRED
6 FIFTY THOUSAND DOLLARS ($450,000); AND FOR OTHER PURPOSES.

8 WHEREAS, on April 2, 2002, pursuant to Little Rock, Ark. Res. No. 11,250, the City Board of
9 Directors authorized the City Attorney to initiate an eminent domain action to enable the City to
10 acquire acreage within the site known as the Little Rock Housing Authority Booker Homes Site located
11 on Springer Hill Boulevard for park purposes, particularly those in conjunction with the City's planned
12 Audubon Nature Center in the Fourche Creek watershed, and
13 WHEREAS, the owner of the identified property, The Housing Authority of the City of Little
14 Rock ( "LRHA "), a state agency, has received disposition authority from the U.S. Department of Housing
15 and Urban Development to sell 65 acres of the property, together with all improvements thereon,
16 including the existing community center building, to the City for a total price of $450,000;
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
18 ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby expresses its intent to authorize payment to LRHA in
20 the total amount of $450,000. This purchase of the property is contingent upon the Board's passage of
21 an ordinance for short -term financing for the property, or for a different method consistent with
22 Arkansas law.
23 Section 2: Before any payment occurs, the documents concerning the payment and transfer of
24 title shall be subject to approval by the City Attorney.
25 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
26 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
27 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain
28 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
29 originally a part of the resolution.
30 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
31 inconsistent with the provisions of this resolution, are hereby repealed to the extent of such
32 inconsistency.
