Gardner FRIDAY, ELDREDGE & CLARK, LLP 400 West Capitol Avenue, Suite 2000 Little Rock, Arkansas 72201 I111 2025042190 PRESENTED: 08-04-202502:59:42 PM RECORDED: 08-04-2025 03:03:17 PM In Official Records of Terri Hollingsworth Circuit/County Clerk PULASKI CO, AR FEE $20.00 RATIFICATION OF DECLARATION OF RE, STRICTIONS AND COVENANTS FOR LOTS 6A, 7A AND 711, TRACT 1 CIIENAL VALLEY ADDITION AND DEDICATION OF ACCESS AND UTILITY EASEMENTS KNOW ALL MEN BY THESE PRESENTS: THAT, CIIENAL PROPERTY INVESTORS III, LLC, an Arkansas limited liability company, and CIIENAL PROPERTY INVESTORS IV, LLC, an Arkansas limited liability company (each hereinafter called a "Grantor" and collectively the "Grantors"), as the respective owner of Lots 6A and 7, Tract 1 Chenal Valley Addition to the City of Little Rock, Arkansas, in comlection with the replat of Lots 6 and 7 into Lots 6A, 7A and 7B (each a "Lot" or collectively, the "_ytg"), Tract 1 Chenal Valley Addition to the City of Little Rock, Arkansas (the "Pr_o_Derty"), as shown on Plat of record as Instruument Number , recorded on 2025, in the records of Pulaski County, Arkansas (the "Plat") which is subject to and that certain Forty -Fourth Supplemental Bill of Assurance of Chenal Valley Commercial Neighborhood by PotlatchDeltic Real Estate, LLC, successor by name change of Deltic Real Estate LLC, Successor to Deltic Timber Corporation, which incorporates by reference that certain Bill of Assurance of Chenal Valley Commercial Neighborhood of record as Instrument No. 96-68199, filed for record June 21, 2022 as Instruunnent No. 20220043071, records of Pulaski County, Arkansas (the "Chenal Commercial ROA"); that certain Twenty -Sixth Supplemental to Declaration of Covenants and Restrictions of Chenal Valley by PotlatchDeltic Real Estate, LLC, successor by name change of Deltic Real Estate LLC, Successor to Deltic Timber Corporation, which incorporates by reference that certain Declaration of Covenants and Restrictions of Chenal Valley, of record as Instrument No. 89-61706, filed for record June 21, 2022 as Instrument No. 2022043072, records of Pulaski Coluity, Arkansas (the "Chenal DCR") and together with the Chenal Commercial BOA, collectively referred to as the `Bill of Assurance"), hereby ratifies and affirms the Plat and Bill of Assurance covering the Property. There are shown on said Plat that certain 15' Access and Utility Easement which Grantor hereby ratifies and confirms dedication to and for the use as a private, perpetual, non-exclusive easement as a means of pedestrian and vehicular access and way of ingress and egress over, through, upon and across that portion of each Lot as shown on the Plat and for public utilities, the same being, without limiting the generality of the foregoing, electric power, gas, telephone, water, sewer and cable television with the right hereby granted to the persons, firms or corporations engaged in the supplying of such utilities to use and occupy such easements, and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services. Also shown on the Plat is 5' x 25' Sign Easement Area which Grantor hereby ratifies and confirms dedication to and for the use of the owners of the Lots. In addition, Grantor (and its successors) shall have the right to locate irrigation lines and equipment and electric lines and ancillary equipment serving any common landscaping or signs serving the Lots within the utility easement areas located on each Lot.
