LODGE, in their individual capacities as husband and wife and as the Trustees of the Cody and Megan Family Trust u/a/d April 30, 2019 (collectively, "Declarants"), are the sole owners of the following lands lying in Pulaski County, Arkansas: LOTS 4 AND 5, BLOCK 30, PARK VIEW ADDITION TO THE CITY OF LITTLE ROCK, PULASKI COUNTY, ARKANSAS (the "Property"); WHEREAS, the Declarants find it desirable that the Property be replatted as provided herein; NOW, THEREFORE, the Declarants, for and in consideration of the benefits to accrue to Declarants and their heirs, successors, and assigns, which benefits Declarants ackriowledge to be of value, have caused the Property to be re -surveyed and a replat (hereinafter referred to as the "Replat") made thereof by Benson Jolu-1 LeBoeuf, Reg-istered Land Surveyor (No. 1900), and Joe D. White, Jr., Registered Professional Engineer (No. 7094), said Replat bearing the signature of the said Surveyor and Engineer and being filed of record of even date herewith in the office of the Circuit Clerk of Pulaski County, Arkansas, as Plat Number , said Replat being incorporated herein by reference. Page I of IN FURTHERANCE THEREOF, the Declarants warrant and represent that they have laid off and replatted and do hereby lay off and replat the said Property in accordance with the aforesaid Replat. The Property embraced in said Replat shall be forever lmOwn as: Lest 4R, Block 30, Parkview Addition, City of Little Rock, Pulaski County, Arkansas, all as indicated and depicted on the Replat; and any and every deed of conveyance of the Property describing the same by the lot shown on said Replat shall always be deemed a sufficient description thereof. IN ADDITION, for purposes of this Bill of Assurance, "Owner(s)" shall mean the owner(s) of the Property and refer to each and every person or business entity mho or which is a record owner or subsequently becomes a record owner of a fee or undivided fee interest in all or any portion of the Property. The Property replatted hereunder shall be purchased, acquired, owned, possessed, held and occupied subject to the covenants, restrictions and provisions set forth above and as follows, each of which and all of which shall be covenants running with the title to said Property, and shall be binding upon any Owner and their respective heirs, successors and assigns forever: 1. Setbacks. No building shall be located, constructed, erected, placed, altered, or re - erected on or upon any portion of the Property nearer than the building setback lines as indicated on the Replat. No fence or wall shall be located, constructed, erected, placed, altered, or re -erected within the setbacks required by applicable zoning regulations as indicated on the Replat. 2. Grant of Utility and Drainage Easements. There are strips of land shown and dimensioned on the Replat designated as Utility and/or Drainage Easements, which are reserved for the use of public utilities and/or drainage purposes, respectfully. The filing of the Replat and this Bill of Assurance for record in the office of the Circuit Clerk and Ex-Officio Recorder of Pulaski County, Arkansas, shall constitute a complete and valid delivery and dedication of any and all easements shown on said Replat. 3. Severabili. Invalidation of any one of the provisions herein by judgement or court order shall in no way affect any of the other provisions, which shall remain in full force and effect.
