SUMMARY OF APPLICATION
BFI plans to construct an earth berm that will extend into the right-of-way on the eastern
side of Mablevale Pike. The berm will serve as a screen between Mablevale Pike and the
landfill, and will be planted with trees, seeded and mulched. Drawings attached include a
plan view along Mablevale Pike and cross sections at the power poles and conceptual of
the berm.

Have a new neighborhood association (Sunnymeade) that is applying for a challenge grant from
H & NP to do some minor landscaping. What they want to do is install landscaping at "focal
points" in the neighborhood. These would be small beds behind the curb in several locations and
at 3 corners (see list in attached application).
I have asked Phoebe Stephens, Horticulturist for P & R, to work with them on the appropriate
materials and plants for such locations. They re aware of the height restrictions necessary for
planting in these areas.
This is a low -volume traffic area. I do not anticipate any problems. Your comments will be
appreciated.

SUMMARY OF APPLICATION
Applicant wants to install a 6-foot high fence (metal — simulated wrought iron) in the
Pulaski Street r-o-w, just south of 23rd street. This art studio is in a C-3 zone in a

SUMMARY OF INQUIRY
I occasionally get residents asking if permits are required to do some minor landscaping
in the right-of-way. These typically are a few bushes and flowers, maybe with a raised
bed constructed of 2 or 3 courses of landscape timbers.
My inclination with these is not to perform the normal franchise review process, but to
simply provide a letter to them setting out limitations (line of sight, height, materials,
etc), limited excavation (no more than 12 inches), requiring them to contact One Call
before any excavation, and providing the usual disclaimers on our part for anything that
may cause damage or be damaged. I will ask for a signed copy of the letter for
acknowledgement of these conditions. Generally what you see of this nature out there is
done without asking us.
Please provide your thoughts, criticisms, and suggestions.

FRANCHISE APPLICATION PROCEDURE
Franchise Definition
A request for franchise as referred to in this procedure shall be considered as a
request from a property owner or the owner's legal agent for authorization to use a
part of the public owned right-of-way. Such requests normally involve expansion
of footings for buildings, planting landscaping, installing sprinkler systems, signs,
fences, retaining walls, passageways with the right -of way for foot traffic, etc.

1. Franchise application complete with requested information, including the legal
street address of the proposed franchise.
2. An explanation of the nature and reason for the request.
3. A copy of the survey showing location, dimensions and purpose of the
encroachments.
4. A drawing of the object being placed in the right-of-way. (A scale drawing may

5. Application fee $75 (non-refundable).

FRANCHISE APPLICATION PROCEDURE
All requests for private use franchises will be received by the Franchise
Administrator who will determine if the appropriate documentation has been
submitted. Additional information may be requested if necessary.
Franchise Approval: Once approved a "Franchise Acknowledgement" letter will be
sent. Please sign and return within 30 days from date of letter. Failure to return
"Acknowledgement" letter may result in franchise being revoked. If additional time
is needed please contact our office at 371-4646.
In conjunction with an approved Franchise, other permits (i.e. building, sign, street
cut, barricade, etc.) may also be required.
Processing time is 30 working days from the date the request is
received by this office.
There are several entities that must approve the request and forward their response
to this office. Your request is processed as quickly as possible and we appreciate
your patience.

Franchise granted subject to the following:
• Landscaping and irrigation permitted in the Maryland right-of-way in accordance with requirements
of the City Beautiful Commission at its meeting on Thursday, March 2, 2006.
• Arkansas One Call must be contacted at 1-800-482-8998 to locate utilities prior to the
beginning of construction/excavation.
■ It is preferable that trees be located at least 5 feet away from underground utilities. Smaller, slower
growing trees should be used where there are overhead utilities present. Granting of this franchise
for the irrigation system does not ensure such facilities will not be damaged by normal or
emergency repair or maintenance work on underground utilities previously permitted in the right-
of-way.
o The City assumes no maintenance responsibility for the permitted item. The City shall not be
responsible for damage to the item by the City or by utility (public or franchised private) crews
while performing normal maintenance work in the public right-of-way or easements. The City
assumes no liability for personal injury or property damage as a result of the placement of permitted
items and the applicant shall indemnify and hold the City harmless from actions, claims, costs,
damages and expenses to which the City may be subjected arising out of the placement of permitted
items in the public right-of-way.
• The franchisee acknowledges that upon notice from the Director of Public Works, the franchisee
will remove the permitted items from the public right-of-way or easements at their own expense for
any public improvement project or if the situation becomes a public nuisance.
