Sec. 15-52. - Preservation, protection and planting.
(c) Continuous maintenance. Once a landscape plan has been approved, a digital and hard copy of the
approved plan shall be provided to the city and also kept on file with the owner/management company.
The plan shall remain on file with the city, and the site shall be maintained in conformance with the
landscape plan. Any landscaping materials or preserved or required trees that die within one year of
planting shall be replaced one (1) for one (1) by the responsible party unless additional trees are
required to be planted to meet the spacing requirements of this chapter in effect on the date of the
most recent approved landscape plan.
After one (1) year of planting, any trees that die shall be replaced in accordance with the tree credits set
forth in this section. Trees that are destroyed or removed by act or consent of the responsible party
shall be replaced in accordance with the tree credits set forth in this section. Replacement shall occur as
soon as reasonably possible in accordance with the approved landscape plan and good horticultural
practices and in compliance with this chapter.
Sec. 15-7. - Enforcement.
(b) [Approved landscape plan required.] All property subject to the requirements of this chapter shall be
developed in conformance with an approved landscape plan. The removal or improper preservation of each
required tree shall be considered a separate violation. Each violation shall be considered a separate offense.
Sec. 15-83. - Maintenance.
(c) The neglect or refusal to maintain as described in this section, after ten (10) days' written notice by
the city, shall be considered a violation.

Attached is a pdf of the approved landscape plan for your property on Baseline Road. As we discussed this will need to
be printed and the proposed, size, specie, and location of the new trees will need to be drawn in and resubmitted back
to my office for approval before the required replacement trees are installed.
I would suggest contacting an architectural printing company such as Southern Reprographics to provide full size copies
of the attached pdf. The pdf can be emailed to their facility and they can deliver any prints needed to your office.

To satisfy the existing tree removal violation it has been determined that twelve (12) three (3) inch caliper replacement
trees will need to be installed. These should be placed in the street frontage areas (Inside of the property line. Trees are
not permitted in the street right-of-way) adjacent to 1-30 and Baseline Road. Possibly six (6) trees on each frontage.
Any specie of tree that meets the three (3) inch caliper specification and the USDA plant hardiness zone for Central
Arkansas will be acceptable. However, we did discuss the use of readily available material that can be obtained from
local nurseries. Two of these plants were Tree Form Foster Holly which are smaller evergreen trees, and Willow Oak
which is a larger deciduous tree. For your reference photos of these plants are shown below. Other acceptable plants
but not limited to, could be varieties oaks, elms, red maples, magnolia, holly, chinese pistach, redbud, leyland cypress or
emerald green arborvitae.

Recently three (3) large trees have been removed from the Dixie Cafe property located at 10011 1-30.
In reviewing the approved landscape plan dated 7-6-96 these were shown to be two (2) willow oaks
located adjacent to the site entrance from 1-30 and one (1) pin oak located on southwest corner of the
property. Upon site inspection by the Plans Development Administrator it was noted that the stumps
had been removed. However, photos of these stumps had been taken immediately after the tree
removal and it is estimated that the size of each was between thirteen (13) and (18) inches in diameter.
In accordance with Sec 15-52 of the City Code any trees that die after one (1) year or any trees that are
destroyed or removed shall be replaced in accordance with Tree Credit Chart of this Section. A tree
between (13) thirteen and eighteen (18) inches would require a replacement of four (4) trees a
minimum of three (3) inches in caliper. The removal of three (3) trees within this range would require a
total of twelve (12) replacement trees a minimum of three (3) inches in caliper. These replacement trees
will need to be placed in the street buffers between the property line and the back of the parking curb.
These will need to be divided between both buffer areas adjacent to Baseline Road and 1-30.
During the site inspection it was noted that other trees have died or been removed. In addition it was
discovered that volunteer trees have grown and been retained. To provide a refreshed landscape and
enhance the property only twelve (12) replacement trees will be required for the recent removal the
trees shown on the approved plan.
Please submit plans showing the locations, type, and sizes of the proposed replacement trees to Plans
Development Administrator D. Tracy Spillman for review and approval.
