HomeMy WebLinkAbout22678 1 ORDINANCE NO. 22,678 2 3 AN ORDINANCE TO AMEND CHAPTER 32, ARTICLE V, SECTION 32- 4 194 OF THE LITTLE ROCK CODE OF ORDINANCES;TO DECLARE AN 5 EMERGENCY; AND FOR OTHER PURPOSES. 6 7 WHEREAS,the Board of Directors of the City of Little Rock,Arkansas, has adopted Chapter 36 of 8 the Little Rock Code of Ordinances,which governs traffic within the corporate limits of the City;and 9 WHEREAS,there is now a desire to amend Chapter 32,Article V, Section 32-194 of the Code;and 10 NOW,THEREFORE,BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 11 OF LITTLE ROCK,ARKANSAS: 12 Section 1. Little Rock,Ark.,Rev.Code Chapter 32,Article V, Sec.32-194 is hereby amended to read 13 as follows: 14 Sec. 32-194.—Violating weight restrictions or prohibitions on truck or commercial traffic on certain 15 roads. 16 (a)Through trucks or commercial vehicles categorized as Class 9,Class 10,Class 11,Class 12,or 17 Class 13,as defined by the U.S Department of Transportation Federal Highway Administration,Figure C- 18 1 FHWA 13 Vehicle Category Classification shall not be permitted on Frazier Pike and shall be punished 19 as provided in subsection(b)of this section, so long as the prohibitions or limitations shall be designated 20 by appropriate signs placed on such roadways. Each day or part of any day during which a violation is 21 continued or repeated shall constitute a separate offense. 22 (b)The penalties provided for in this section shall not apply to: 23 (1)Farm tractors or equipment; 24 (2) Emergency vehicles or equipment that are used to transport personnel or to support the 25 suppression of fire or mitigation of other hazardous situations; school buses; any commercial sanitation 26 vehicle hauling putrescible or non-putrescible refuse or waste; commercial delivery vehicles making 27 deliveries to local businesses or residences that cannot be made on another road; 28 (3) Operators of vehicles in possession of a hauling permit issued and approved by Pulaski 29 County or City of Little Rock Public Works;or 30 (4)Local deliveries. 31 (c) The penalty for violation of the limitations or prohibitions described in subsection (a) of this 32 section shall be a one hundred dollar($100.00)fine.A second or subsequent offense within a year shall be 33 a fine of two hundred fifty dollars($250.00)for each offense. [Page 1 of 2] 1 (d) The public works department shall place and maintain appropriate signs indicating roadways 2 which are subject to the provisions in this section. 3 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 4 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 5 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 6 effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the 7 ordinance. 8 Section 3. Repealer. All laws,ordinances, resolutions,or parts of the same,that are inconsistent with 9 the provisions of this resolution,are hereby repealed to the extent of such inconsistency. 10 Section 4. Emergency Clause. There is hereby found and declared to be an immediate need for the 11 establishment of weight restrictions or prohibitions on truck or commercial traffic on certain roads which 12 benefits the public health,safety, and welfare of the City and the inhabitants thereof.
