Margaret,
The CBC only reviews variances concerned vi th Chapter 15, Landscaping and Tree Protection. The drives are a function
of the Zoning and Civil codes . The only varia PCe issue that was presented to the commission was the south three (3)
foot perimeter landscape strip, which was w,.j, rimou-Ily ipproved. A week prior to yesterday's meeting the
commissioners were sent the latest landscci > and site layout via email that was provided by your firm. The only other
visuals that were presented in yesterday's n tine, w,re hard copies provided Adams Engineering representative, Matt
Korte. As I relayed to Matt before the mee! is ,,.:vas c,Iled to order the commissioners sometimes get off task and begin
to ask questions that do not concern the rec hest that has been brought before them. I also conveyed that we will both
need to keep them on task if their questioner, strays too far off topic. They often become interested in the overall
development and want to discuss features that do not concern their duties. I believe this is what happened and may be
what you are referring to below.
Yesterday's variance was approved with th=, n cliteon that two additional landscape islands be provided to the south
parking area. No further CBC action will be r1uire(l. The only other item concerning this project that may come up is if
the site plan submitted for building perrnit not )atch the one approved by the Planning Commission or Board of
Adjustment. However, if this was changed o a r,, qt i-st in one of these meetings approval can usually be
accomplished at Staff level without the pre ss of �w,)ther public hearing.

Good morning! I have spoken to Matt abo.;t the me(-ting yesterday and have a few questions for you.
1. You and I discussed the drive way cl, roles on Broadway and you requested the updated plan to be sent to
you. I was surprised to hear that V,..;� plan wns not brought before the CBC and if the drives change to what we
are now showing, we will be requir -,,! to go h-ick to the CBC. Is this correct? Why wasn't the newer layout not
presented to the CBC?
2. The drive(s) were revised per Engin-(,ring comments relating to the traffic study done. Does the CBC have the
authority to deny landscape appro,., i' regarding; city engineering requirements?
3. Would the drives be considered ow- de the scope of the CBC?
McDonald's is needing to get this store per i tt ,d aml started construction before the end of the year. We don't want
another Rodney Parham situation. If you c-c Id hel-) ;,mvide further explanations of what is required and how we can
move forward, we would appreciate it.
